BOA12D OF ZONIleTG APPEALS <br />CITY OF NORTH OLMSTED <br />1VIIleTUTES OF MAY 6, 2013 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:05 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Laura Bellido, Michael Raig, Alfredo Lopez <br />Absent: Maureen Diver <br />Staff: Law Director Michael Gareau, Planning & Development Director Kimberly Wenger, <br />Clerk of Commissions Donna Rote <br />REVIEV6V AND CORRECTION OF MINUTES <br />Mr. Lopez moved, seconded by Ms. Bellido, to approve the April 1, 8013 minutes as written <br />which passed 4-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />Emilv Sanders & Chad Zelinko; 23981 Ambour Drive <br />Proposal consists of a fence; the following variance is requested: a variance for a solid, 6-foot high <br />fence on a corner lot located beyond the neighbor's front setback. Applicant shows a 6-foot <br />privacy fence within the neighbor's front setback; code requires corner fences to be at least 50% <br />open and no more than 30 inches high, Section 1135.02(fl. <br />The oath was administered to Emily Sanders and Chad Zelinko, Councilman Paul Barker and <br />neighbor Rich Crumbly. Ms. Sanders said they purchased their home within the past year. They <br />would like to fence in their backyard for their pets and family privacy. Mr. Crumbly said existing <br />trees will block the view of the fence which will not adversely impact the neighborhood. He <br />commended the owners for the improvements they've made to their lot. Councilman Barker said <br />the applicant's fence will run evenly with the garage, will be 3 feet in from the sidewalk and will not <br />impede the neighbor's view. The location and placement of the home on the corner lot denies the <br />owners any privacy and placing the fence to code would minimize the owners use of their own <br />property. Therefore he supports the owners request for a variance. Ms. Wenger reviewed the <br />building official's report which said he had no objections as it doesn't adversely impact the <br />neighborhood nor block the neighbor's view. Board members had no objections as the existing <br />trees would block the view of the fence and installing a fence would not be out of character of the <br />neighborhood. <br />Ms. Bellido anoved, seconded by Mr. Lopez, to grant Emily Sanders & Chad Zelinko of <br />23981 Ambour Drive a variance for a solid, 6-foot high fence on a corner lot located beyond <br />the neighbor's front setback. Applicant shows a 6-foot privacy fence within the neighbor's <br />front setback; code requires corner fences to be at least 50% open and no more than 30 <br />inches high, Section 1135.02(f), which passed 4-0.
