<br />a 576 sq. ft. detached garage distance from a dwelling on the same lot; code requires 15 ft. <br />separation, applicant shows 3 ft., Section 1135.02(c)(2), which failed 5-0. <br />App14-2243 Fred Krause; 5683 Columbia Road: <br />Proposal consists of a section of split rail fence and the following variance is requested: <br />An 18 inch height variance for a split rail fence higher then allowed within the front yard <br />setback; code permits 30 inches high, applicant shows 48 inches high, Section 1135.02(f). <br />The oath was administered to Marcella Krause and neighbors Sharon Tadj and Michael Flynn. <br />Ms. Krause said they've owned the home since 1972 and when they purchased it the split rail <br />fence was in place and they've maintained it. The north length of split rail fence was on their <br />neighbor's property which she maintained until this year when she removed a 50 foot section of <br />the fence. As they would like to have all three sides fenced they hired a fencing company to <br />install the split rail fence along their north property line which they will maintain. The fence <br />company pulled the proper permits and installed the fence 20 feet in from Columbia Road. As <br />the fence is more than 50% open neither vehicular or foot traffic is impeded and the fence . <br />matches the existing split rail fence. Mr. Flynn said the fence helps the yard look uniform and <br />fits the style of home therefore he has no objections. Mr. Russell said a permit was issued to <br />install the split rail fence up to the edge of the home however it was installed beyond the front <br />setback which creates the need for a height variance. Ms. Rudolph said the fence fits the style of <br />the home, doesn't impede visibility therefore she has no objections. Mr. Papotto said the fence is <br />more than 50% open and fits the character of the home and area. <br />Ms. Rudolph moved, seconded by Ms. Bellido, to grant App14-2243 Fred Krause of 5683 <br />Columbia an 18 inch height variance for a split rail fence higher then allowed within the <br />front yard setback; code permits 30 inches high, applicant shows 48 inches high, Section <br />1135.02(f) which passed 5-0. <br />App14-2255; Sahar Herbawi; 6366 Christman Drive: <br />Proposal consists of a shed and the following variances are requested: <br />1. A 2 ft. side yard variance for a shed placed in the required 5 ft. side yard setback; code <br />requires 5 ft., applicant shows 3 ft., Section 1135.02(d)(5). <br />2. A 3-1/2 ft. rear yard variance for a shed placed within the 10 ft. swale easement; code does <br />not permit, applicant shows 6-1/2 ft., Section 1135.02(d)(4). <br />The oath was administered to Sahar Herbawi and son Ferras Daies. Mr. Daies said the contractor <br />was hired to build the shed as was approved by the building department but they installed the <br />shed on an existing slab from a previous shed. Mr. Russell said he has no objections to the <br />request however noted plans which were approved and issued a permit met zoning code <br />requirements. The violation was found upon final inspection. The city engineer has no objections <br />as shown as long as the area is clear of debris. Mr. Raig said he agreed with the engineer that as <br />long as it is clear of debris he has no objections. <br />Mr. Raig moved, seconded by Mr. Papotto, to grant App14-2255; Saher Herbawi of 6366 <br />Christman Drive the following variances for a shed: <br />2
