<br />BOA12I) OF ZONING APPEALS <br />CITY OF NORTH OLIVISTED <br />1VIINiJTES OF OCTOBER 6, 2014 <br />ItOLL CAL,L <br />Ms. Rudolph called the meeting to order at 7:01 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Michael Raig, Bob Papotto <br />Absent: Laura Bellido, Eric Allain <br />Staff: Law Director Michael Gareau, Assistant Building Commissioner Daniel Russell, Clerk <br />of Commissions Donna Rote <br />REVIEW AND CORI2ECTION OF MINU'I'ES <br />The minutes of September 8, 2014 were postponed until the November meeting. <br />RESIDENTIAL APPELAS AND REQUESTS <br />App14-1619 Robert Perkins; 6275 Stearns Road: <br />Proposal consists of a home occupation (landscape business) at a residential property within a B <br />One-Family Residential Zoning District. The following variances are requested: <br />1. A variance for non-family members worlcing at the business; code does not permit, applicant <br />shows up to 8 non-family employees, section 1135.02(b)(1). <br />2. A variance for the business occupancy not conducted wholly within the residential dwelling; <br />code does not allow, applicant shows business use outside of dwelling, section 1135.02(b)(2). <br />3. A variance for work truclcs or other mobile equipment parked overnight in driveways and <br />open yards, and the number of automobiles on the premises associated with the business <br />being a greater number than normally associated with a single family residence; code does <br />not permit, section 1135.02(b)(6). <br />The oath was administered to Robert Perkins. He has a small commercial landscape company. <br />His home is located in a unique area abutting 1-480 to the north, and land is vacant to the west, <br />east and south of his property. His business is not visible from the street, all vehicles are parked <br />behind his home and equipment stored within the pole barn. Ms. Rudolph asked how long the <br />business had been located there. Mr. Perkins said he's owned his business for 12 years and he's <br />operated his business from home for 7 years. Mr. Raig asked how many employees and vehicles <br />are at the site daily. Mr. Perlcins said the daily average number of employees is 6, with 3 personal <br />vehicles and 4 work trucks. Each night the worlc trucks are lined up along the back so they are <br />not visible from the front. Mr. Russell said he had no objections to the request. Mr. Raig said the <br />lot is very large, there are no neighbors to spealc of, and the business is not visible from the front <br />of the home. Ms. Rudolph said the size and location of the lot is ideal for the business. Board <br />meinbers agreed the business is not be detrimental to the character of the neighborhood.
