A 22 ft. rear yard variance for rear yard setback; code requires 50 ft., applicant shows <br />28 ft., Section 1135.08 (a). Note: existing rear yard setback is 36ft. <br />2. A variance for one additional shed; code permits 1, applicant shows 2, section <br />1135.02 (d)(1). , <br />3. A 56 square foot variance for maximum allowable square footage of an accessory <br />structure; code permits 120 sq. ft., applicant shows 176 sq. ft., section 1135.02 (b)(1). <br />4. A 227 square foot variance for exceeding 20% rear lot coverage; code allows 1171 sq. <br />ft., applicant shows 1398 sq. ft., section 1135.02 (d)(3). <br />Motion passed 5-0. <br />Ms. Rudolph moved seconded by Ms. Bellido to grant App14-1808: William Healy of 26760 <br />Ross Circle a special permit to add to a non-conforming building as existing home is 36 ft. <br />from the rear property line, chapter 1165.02, which passed 5-0. ' <br />App14-1821; Christopher Hartenstine; 23784 Vincent: <br />Proposal consists of covering existing concrete patio. <br />1. A special permit to add to a non-conforming building is required; existing home is 45' from <br />rear property line 1165.02. <br />2. A 17 foot variance for rear yard setback is required; code requires 50 ft., applicant shows 33 <br />ft., section 1135.08(a). <br />The oath was administered to Mr. Hartenstine. He said he would like to put an awning over his <br />existing patio. The condition of the old covering was such it needed to be replaced so a <br />contractor was hired to remove it and when he.applied for the permit, it was denied due to the <br />distance from the rear yard line. The distance will be 33 feet from the rear property line. The <br />covering removed was a 20'x12' aluminum sheeting roof which was in poor condition due to age <br />and buckling from inclement weather. The new roof will be the same dimensions however the <br />roof material will be a translucent Lexan product which will withstand the weather. Mr. Russell <br />said he had no objections to the request. Mr. Raig asked what abutted the applicant's property <br />and Mr. Hartenstine said he abuts a Westlake drainage field. Mr. Raig said the abutting property <br />is a drainage ditch therefore he had no objections. <br />Mr. Raig moved, seconded by Ms. Rudolph, to grant App14-1821; Christopher Hartenstine <br />of 23784 Vincent a 17 foot variance for rear yard setback; code requires 50 ft., applicant <br />shows 33 ft., section 1135.08(a), which passed 5-0. <br />Ms. Rudolph moved, seconded by Ms. Bellido, to grant App14-1821; Christopher <br />Hartenstine of 23784 Vincent a special permit to add to a non-conforming building as the <br />existing home is 45' from rear property line 1165.02, which passed 5-0. <br />2
