The following variances are requested: <br />1. A 3 ft. variance for side setback for a storage shed; code requires 5 ft., applicant shows 2 ft., <br />Section 1135.02(d)(1)(5). Note: 1. <br />2. A 9 in. variance for rear setbaclc of shed; code requires 5 ft., applicant shows 4 ft. 3 in., <br />Section 1135.02(d)(1)(5). Note: 1. <br />3. A 20 sq. ft, variance for a storage shed larger than code allows; code permits 120 sq. ft., <br />applicant shows 140 sq. ft., Section 1135.02(d)(1). <br />4. An 8 ft. variance for an animal structure (pigeon coup) too closes to side property line; code <br />requires 10 ft., applicant shows 2 ft., Section 1135.02(e). Note: 1& 2. <br />5. Water rLtnoff of pigeon-coup roof which extends to within 6 in. of fence. <br />The oath was administered to the Enea Pavliqoti, Gani Pavliqoti and neighbors Cherie Morgan, <br />Lorraine Lipinslci, Marie Gibbons, and Joe Nader. Mr. Pavliqoti said he would be representing <br />his father as his father doesn't speak English well. Since the home was purchased two years ago <br />his parents have worlced hard to improve the home and yard. Last year due to the amount of yard <br />equipment they purchased a shed to store their items. They spolce to neighbors prior to building <br />the shed and their only request was for it to look nice. When they built the shed they didn't <br />know the required setbacks and size limitations or that a permit was required. The placement of <br />the shed was chosen so they could re-grade and seed the backyard which had issues with <br />standing water. They were also unaware that an animal shelter couldn't be any closer than 200 <br />feet from any residence. They require a variance for the pigeon coop as the size and shape of the <br />lot cannot accommodate the requirements. He does not believe the pigeons are a nuisance or <br />change the character of the neighborhood as they are locked up during the day and let out once. <br />Ms. Morgan said she was told about the shed after the construction of the shed began; during <br />construction she told them they needed to apply for a permit. She is not opposed to a shed but the <br />size is quite large and the shed was built in the middle of the drainage swale which is an <br />easement. She aslced if anything was allowed to be constructed in an easement. She submitted <br />photos of what she sees from her house and backyard. The pigeons have been a problem since <br />they have been in the neighborhood. Trees have been cut to give the birds a place to perch. The <br />owners use BB guns to shoot at other birds to lceep thein away. She is concerned for the safety <br />of her child as the pigeons carry a variety of communicable. diseases and leave droppings all over <br />their home and yard. The applicant's yard is draining into her yard causing it to flood and render <br />her baclcyard unusable. She's filed complaints with the city and nothing has been changed. Ms. <br />Lipinski said she objects to the coop, they are not contained within the owner's yard, they leave <br />droppings on neighboring vehicles, homes, and yards; they attract rodents, spread corrimunicable <br />2
