2. A variance for a fence less than 50% open in neighbor's 50 ft. front setback on a corner lot; <br />code requires 50% open, applicant shows privacy shadow box, Section 1135.02 (f)(2)&(1). <br />The oath was administered to Tom and Julie Dunn. Mr. Dunn said the home is on a corner lot <br />and placing the fence to code would render their yard unusable. A letter from his abutting <br />neighbor was submitted stating they had no objection. Mr. Russell said he had no objections to <br />the request. Mr. Dunn said the fence would start at the edge of the home and along the back <br />property line and would not impede the visibility of vehicular traffic. Mr. Papotto asked if the <br />area of 50 feet was the only area which doesn't meet code and Mr. Russell said yes. Mr. Dunn <br />said there will be a shadow box style fence installed as shown. Mr. Raig felt that the request was <br />not unreasonable due to the restrictive requireinents placed upon the corner lot. The board felt <br />the request was warranted for safety and the use of the yard and it would not change the <br />character of the neighborhood. <br />Ms. Bellido moved, seconded by Mr. Raig, to grant APP14-1151: Rosanne Dunn of 26154 <br />Byron Dr. the following vaa-iances: <br />1. A 2.5 ft. height variance for a fence higher than code allows in neighbor's 50 ft. front <br />setbaek on a corner lot; code permits 30", applicant shows 5 ft., Section 1135.02(f)(2). <br />2. A variance for a fence less than 50% open in neighbor's 50 ft. front setbaclc on a corner <br />lot; code requires 50% open, applicant shows privacy shadow box fence, Section 1135.02 <br />(f)(2)&(1)• <br />Motion passed 4-0. <br />APP14-1274: Dominic & Faith Rodriguez; 4154 Dover Center Rd. <br />Proposal consists of a fence and the following variances are required: <br />1. A variance for a six (6) ft. fence in a neighbor's 50 ft. setback on a corner lot; code does not <br />perinit, applicant shows six (6) ft. fence, Section 1135.02(f). <br />2. A variance for a fence less than 50% open in neighbor's 50 ft. front setbaclc on a corner lot; <br />code requires 50% open, applicant shows privacy dog eared fence, Section <br />1135.02(0(2)&(1). <br />The oath was administered to Faith Rodriquez and neighbor Tom Benson. Ms. Rodriguez <br />submitted a letter from her neighbor stating they had no objection to the request. Placing the <br />fence to code would place the fence in the middle of the yard and the corner their hoine is <br />located on is a high traffic area. They are concerned for the safety of their children. The fence <br />would provide buffering from vehicle sounds and provide privacy for their family. Mr. Benson <br />said he has no objections to the request and invited his neighbor to abut their fence to his. Mr. <br />Russell said he has no objections. Mr. Raig aslced the style of fence to be installed and Ms. <br />Rodriquez said the fence would be a solid fence. Mr. Papotto said he was concerned fences <br />along both sides of the street would appear alley like. Mr. Raig said the abutting neighbor's line <br />of sight will not be impeded by the fence but he would prefer the fence in line with the edge of <br />the home. Mr. Allain said this home is on a very busy street and without a fence he doesn't <br />believe a parent would allow their child in the yard due to their safety. He said the requirement <br />is a hardship and all members agreed. <br />Mr. Allain moved, seconded by 1VIr. Raig, to grant APP14-1274: Dominic & Faith <br />Rodriguez of 4154 I)over Center Rd. the following variances: <br />4
