He said his home is on the southeast corner of Gessner
and Walter Road which is a very busy street. The prior 4 foot fence did not provide privacy and
the safety needed for his family. While removing his fence his neighbor contacted the police and
the responding officer said the concern of the neighbor was the safety and visibility of vehicular
traffic, pedestrians and children on bikes. The fence would not impede the neighbor's line of
sight. The fence will follow the existing lines of the old fence and will leave a 2 foot overlap to
the east. The fence will be a solid fence for privacy and safety of his family. Mr. Russell said he
had no objections to the request. Mr. Papotto asked if the 10 foot distance is from the sidewalk
or the street and Mr. Ortiz said the fence will be 12 feet in from the sidewallc. The fence will be
about 2 feet off the side of the home. Mr. Allain aslced if a variance was granted for the previous
fence and Mr. Russell said he was not aware of any previous variances. Mr. Ortiz suggested the
inspector said the previous fence was never granted a variance nor was there ever a permit
issued. Ms. Bellido said when visiting the site she had no issues pulling in and out of the drive
and understood the need for a fence for the protection of their family. Mr. Papotto said the fence
will be 12 feet off the sidewallc and visibility will not be an issue.
Mr. Papotto moved, seconded by Mr. Allain, to grant APP14-1295: Jose Ortiz of 24479
Gessner Rd. the following variances:
1. Ms. Manrodt said they were granted a
variance in June 2014 for an extension of their garage however it was found that the two garages
can't be attached.
