2. A 1 ft. 9 in. variance for an accessory building higher than code allows; code permits 10 <br />ft., applicant shows 11 ft. 9 in., Section 1135.02(d)(1). <br />3. A variance for a second storage building on a lot; code permits 1, applicant shows 2, <br />Section 1135.02(d)(1). Note: An existing 30 ft. x 17 ft. 6 in. barn will remain. Deck in <br />rear of existing barn must be removed. <br />Motion passed 4-0. <br />CMS14-09: Stanlev & Barbara Fulton; 23905 Frank St <br />Proposal consist of a new garage. The following variance is requested: <br />1. A 3.5 ft. variance for a garage too close to side property line, code requires 5 ft., applicant <br />shows 1.5 ft., Section 1135.02(c)(2). Note: Existing garage to be demolished and new garage <br />placed in same location. <br />The oath was administered to Stanley and Barbara Fulton and contractor Tom D'Amico. Mr. <br />Fulton said they have lived in their home for 44 years, and the garage needs to be replaced. If the <br />garage is located following code the garage would be in the middle of the backyard. The lot is only <br />50' wide. The proximity of the garage to the house would also make access to the garage <br />impossible. There is also a maple tree which would have to be removed to move the garage. The <br />new garage will use the footprint of the existing garage. Access is also a concern. Mr. Russell said <br />the building department had no objections to the request. Ms. Rudolph asked why the garage was <br />being replaced. Mr. Fulton said the slab has deteriorated and has draining issues. <br />Ms. Rudolph moved, seconded by Mr. Allain, to grant CMS14-09: Stanley & Barbara <br />Fulton of 23905 Frank St a 3.5 ft. variance for a garage too close to side property line, code <br />requires 5 ft., applicant shows 1.5 ft., Section 1135.02(c)(2), noting the existing garage will <br />be demolished and new garage placed in same location, which passed 3-0. <br />CMS14-10: Michael Freidhoff; 6442 Mackenzie Rd <br />Proposal consists of a second detached garage. The following variance is requested: <br />1. A 606 sq. ft. variance for a second detached garage exceeding 750 sq. ft: total floor area for a <br />private garage; code permits 750 sq. ft., applicant shows 1,356 sq. ft., Section 1135.02(c)(1). <br />2. A variance to permit a second detached garage in addition to an existing storage shed, section <br />1135.02 (d)(1). <br />The oath was administered to Mr. and Mrs. Freidhoff and neighbor Shirley Butera. Ms. Freidhoff <br />said they need to store their outdoor tools and recreational vehicles. They have a shed which <br />stores their riding mower but a storage area for their recreational vehicles is needed. Ms. Butera <br />said she lived in her home for many years and the Freidhoffs are the first owners who have <br />worked to improve the appearance of the property. The lots are very large on Mackenzie so the <br />storage shed would not adversely impact the neighborhood. Mr. Russell said he had no <br />objection. Ms. Rudolph asked if there would be a driveway to the second storage garage. Ms. <br />Freidhoff said the vehicles would only be used once or twice a year. The existing shed will be <br />kept as it will store the children's toys and bikes. Mr. Allain said the area has large lots and as <br />each lot is unique there is no real character to the neighborhood. He is concerned there is no <br />driveway and the existing shed is remaining. Ms. Rudolph said lots of these sizes require larger <br />yard tools and families have more vehicles for recreation. Ms. Bellido said the shed would not be <br />2
