<br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF APRIL 7, 2014 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:01 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Laura Bellido, Michael Raig, Alfredo Lopez, Eric Allain <br />Staff: Law Director Michael Gareau Jr., Assistant Building Commissioner Daniel Russell, <br />Clerk of Commissions Donna Rote <br />REVIEW AND C0RRECTION OF MINUTES <br />Ms. Rudolph moved, seconded by Ms. Bellido, to approve the BZA minutes of February 3, <br />2014 as amended, which passed 5-0. <br />RESIDEN'I'IAL APPEALS ANI) REQUESTS <br />CMS 14-02: Neal Homer; 4070 Clague Road <br />Proposal consists of a new storage building. Applicant requests a 176 square foot variance for an <br />accessory storage building larger then code allows; code permits 400sq ft. applicant shows 576sq ft., <br />section 1135.02 dl. Note: existing shed to be removed. <br />The oath was adiniiustered to Neal Homer. Mr. Homer said he would like a 24' x 24' pole barn to <br />store his yard tools which are needed due to the size of his property. The existing shed will be <br />removed. Mr. Russell said the variance would need to be amended as the lot square footage was <br />miscalculated. County tax records show the.lot size to be 67,691 sq. ft. which allows a 300 sq. ft. <br />structure not 400 sq. ft., therefore a 276 sq. ft. variance is required. He asked the applicant for <br />confirmation that the existing shed would be removed and Mr. Homer said it would be removed. <br />Ms. Rudolph asked if thought had been given to placing a smaller storage unit further back on the <br />property. Mr. Hoiner said beyond the proposed location, the trees are dense. If the storage unit is <br />placed amongst the trees the cost to make it fit would be prohibitive and the risk of damage from <br />severe weather a concern. He has had to store yard equipment in his neighbor's storage unit and a <br />smaller unit would require his equipment to be stacked and harder to access when needed. Mr. Raig <br />said he is familiar with Clague Road which has very large lots and storage units of this size are not <br />uncommon due to the size of equipment needed to maintain the lots. The size and placement of the <br />unit will not adversely impact the neighborhood and improve the owner's line of sight as it would <br />block the view of neighboring storage units. Mr. Lopez said although the lot is very large the <br />storage unit is almost double what is allowed. Ms. Bellido said it didn't appear that the storage unit <br />would be visible from the right of way or change the character of the neighborhood. <br />Mr. Lopez moved, seconded by Mr. Raig, to grant CMS 14-02: Neal Homer of 4070 Clague <br />Road a 276 square foot variance for an accessory storage building larger then code allows; <br />code permits 300 sq ft. applicant shows 576 sq ft., seetion 1135.02(d)(1), noting the existing <br />shed is to be removed which passed 5-0.
