CMS14-03: Bill Ruda; 3419 Clague Road <br />Proposal consists of a new single family home. The following variances are required. <br />1. A 1.35 foot variance for required side yard setbaclc, code requires a total of 20ft, applicants <br />shows 18.65ft, section 1135.07 (a). <br />2. A 1.35 foot variance for homes side yard setback, code requires Sft, applicants shows 3.65ft, <br />section 1135.07 (a). <br />The oath was administered to Bill Ruda, the neighbor's son Bob Kidd and Councilman Paul <br />Barker. Mr. Ruda submitted photos of the existing site and reviewed the distance of his garage to <br />neighboring homes. The narrow lot size restricts the size of home which can be built. The home <br />he chose was the smallest he could find which would require the least amount of variances. The <br />home is 29 ft. wide by 60 ft. long, with a total square footage of around 1,400 sq.ft. which meets <br />the livable square footage requirements. However neither the required 20 foot combined total <br />side yard or minimum 5 foot side yard requirement can be achieved. The detached garage is <br />preexisting and roughly 100 feet from the nearest structure. The city has required he construct a <br />home or remove the existing garage. Mr. Kidd asked if the dimensions listed on the plan were <br />accurate and if granting the variances would impede his parents' rights on their property. He <br />asked if a smaller house could be built which would eliminate the need for variances and if the <br />home once built would be used as a rental property, noting the garage was already being leased <br />out as a storage unit. Councilman Barker said although neighbors are glad to see a home <br />constructed, there have been a few property maintenance issues cited for overgrown grass, <br />parlced cars and cars for sale which shouldn't be an issue once the home is occupied. If the new <br />home is to be a rental property the owners are required to register with the building department <br />as landlords. He asked what the garage would be used for and Mr. Ruda said once the home is <br />built the site would become a rental property. He has multiple rental units and believes he is a <br />good landlord. Mr. Kidd aslced if the home and garage could be rented out to separate people and <br />Mr. Gareau reviewed city codes pertaining to garage and home rental uses. Mr. Kidd questioned <br />the measurements shown on the plans. Mr. Russell reviewed the variances required and had no <br />objections to the request. Board members felt the style and size of the home fit the lot and would <br />not adversely impact the neighborhood. <br />Mr. Raig moved, secondecl by 1VIr. Lopez, to grant CMS14-03: Bill Ruda of 3419 Clague Road <br />1. A 1.35 foot variance for homes side yard setback, code requires Sft, applicant shows 3.65ft, <br />section 1135.07 (a). <br />Motion passed 5-0. <br />CMS14-05: Nathan Wheatlev; 27372 Cottonwood Trail <br />Proposal consists of a new carport. Applicant requests a 3 foot variance for structure too close to <br />the side property line; code requires 5 ft., applicant shows 2 ft. section 1135.07 (a). <br />The oath was administeiā¢ed to Nathan Wheatley and neighbor Linda Staskus. Mr. Wheatley said <br />he seeks permission to construct an attached carport on the eastern side of his home above an <br />existing parking slab. The application includes a summary for reasons the variance is warranted.
