The request is based on issues which have arisen from a basement vent that partially melts the <br />snow and creates ice and standing puddles which is a safety hazard. Although they have a two <br />car garage they are unable to use it due to yard tools and family items stored inside. The carport <br />will be used for a vehicle only and no items will be stored outdoors. Ms. Staskus said she doesn't <br />object to the request however she doesn't find carports attractive. She is concerned allowing the <br />structure to be so close to the neighboring structure creates a fire hazard and lowers her property <br />value. Mr. Wheatley said the structure is aluminum and steel which is not flammable and will be <br />buffered by landscaping. Mr. Russell said the city has no objections to the request. Mr. Allain <br />asked if there were any other homes with carports in the neighborhood and Ms. Staskus said <br />there was a home which faces Dover Center which has a carport. She has lived in her home since <br />1974 and the hoine styles range from ranches, colonials and split levels which have two car <br />garages. Mr. Allain said he is concerned that if the board starts granting variances for carports it <br />would set a precedent for other homeowners to seek such variances. Mr. Gareau briefly <br />discussed granting variances on a case by case bases and whether or not the board sets <br />precedence by granting or denying variances. Ms. Bellido said the area wasn't visible due to <br />landscaping. Loolcing at the style sample submitted it looks more like a covered patio then a <br />carport. Mr. Lopez said if a variance is granted the homeowner could then enclose the carport as <br />an addition or garage therefore he is against the request. Mr. Raig didn't believe the value of <br />homes would be adversely affected or change the character of the neighborhood. Mr. Russell <br />said the homeowner's application for a caiport is governed by chapter 1135.07 which regulates <br />garages not home additions. <br />Ms. Bellido moved, seconded by Ms. Rudolph, to grant CMS14-05: Nathan Wheatley of <br />27372 Cottonwood Trail a 3 foot variance for a structure too close to the side property line; <br />code requires 5 ft., applicant shows 2 ft. section 1135.07(a). Roll call: Rudolph, Bellido, Raig - <br />yes Allain, Lopez - no. Motion passed 3-2. <br />COMMERCIAL APPEALS AND REQUESTS <br />CMS 13-27: Chambers Funeral; 29150 Lorain Road <br />Proposal consists of expanding and reconfiguring the parking lot and landscaping improvements. <br />The following variances are required: <br />1. A 9.16-foot variance for rear yard setback (north parking); code requires a setback of 15 feet <br />where abutting residential property, applicant provides varying amounts between 5.5 feet to <br />5.84 feet, Section 1139.07 table. <br />2. A 14.91-foot variance for side yard setback on a corner lot (east parking); code requires 20 <br />feet, applicant provides varying amounts between 5.09 feet to 17.82 feet, Section 1139.08. <br />The oath was administered to Daniel Chambers and engineer Matthew Neff. Mr. Chambers said <br />they are seeking variances for expanding their existing parking lot. They are following the <br />existing parking setback along the west property line and reconfiguring the internal traffic flow. <br />The variances are required for continuing the west parlcing setbaclc and the corner side yard <br />setback which abuts Stearns Road. The existing fence will be continued along the west property <br />line and the sound walls will remain along the east property line. Mr. Russell said the building <br />department had no objections to the request. Ms. Rudolph asked if the 14.91 foot variance was <br />truly wananted.
