The City maintains the drainage ditch. <br />Ms. Wenger said the property is unique due to being split zoned. The pie wedge along the rear area <br />is zoned residential. The city engineer and forester have been involved to ensure the drainage ditch <br />and vegetation is taken into consideration with this project. She supports the variance requests as <br />the project enhances the site and provides abutting residents additional buffering. Ms. Rudolph <br />questioned the proximity of the residential homes along the rear and Mr. Kluchin said the rear lots <br />are deep. Mr. Sturgeon believed his mother's home to be within 40 feet off the site. Mr. Raig said <br />he was not in favor of a mound and fence or having the fence continued along the west property <br />line, he would prefer landscaping. Ms. Bellido said the proposal improves the site and buffers the <br />residents therefore she has no obj ections to the request. Ms. Rudolph felt continued fencing of the <br />southwest corner could be warranted but would let Council address that issue. <br />Mr. Raig moved, seconded by Ms. I2udolph to grant the following vaa-iances to CMS 13-42: <br />Kensington Court Apartments of 23307 Lorain Road: <br />1. A 54 ft. variance for side setback to recreational use (west adjacent to C One Family <br />Residenee District), 100 ft. required, 46 ft. provided, Section 1118.04(a)(2). <br />2. A 53 ft. variance for rear setback to recreational use (south adjacent to C One Family <br />Residence District), 100 ft. required, 47 ft. provided, Section 1118.04(a)(2). <br />3. A 57 ft. variance for side setback to recreational use (east adjacent to C One Family <br />Residence District), 100 ft. required, 43 ft. provided, Section 1118.04(a)(2). <br />4. A 2 foot variance for height of fence, 6 ft. permitted, 8 ft. shown, Section 1135.02(f)(1). <br />Motion passed 3-0. Ms. Rudolph said her vote includes the recommendation for Council to <br />address the neighbors request to continue the fence around the southwest coiner. <br />CMS13-43: Ml Motors; 28450 Lorain Road <br />Proposal consists of a dlunpster enclosure. The following variances are requested: <br />1. A 5 ft. 1 inch variance for rear yard setbaclc (dumpster enclosure along north property line, <br />adjacent to Residence District); 15 ft. required, 9' 11" provided, Section 1139.07 table. <br />2. A 1 ft. 11 inch variance for side yard setback (east side, adjacent to General Retail Business <br />District); 10 ft. required, 8' 1" is shown, Section 1139.07 table. <br />Project representative Denver Brooker was administered the oath. Mr. Broolcer said the request is <br />due to a new dlunpster enclosure placed along the northeast corner of the property. The location of <br />the dlunpster is needed to address traffic flow within the site. The existing fence will be replaced <br />with a new 10 foot high fence. Ms. Wenger said she had no objections to the request. Mr. Raig <br />asked where the fence would stop and Mr. Brooker said the fence would only be installed along the <br />abutting residential lot.
