Mr. DiFranco said the existing underground storm water detention system shall be expanded to <br />account for the additional impervious area; however stormwater quality is not required as the area of <br />disturbance is less than one acre. The proposed access drive along Stearns Road shall remain right- <br />in, right-out only unless a traffic study is performed. <br />Mr. Chambers thanked the City and his neighbors for working with him while they prepared to <br />expand the parking which is needed. They would like the project to start in the spring. Mr. Rerko <br />said he doesn't object to the proposed placement of the fence as the area will be used to store snow. <br />However he objects to the flags shown on the new monument sign. Mr. Chambers said the flags will <br />be eliminated from the sign feature. Mr. Rerko asked about the trees being relocated and the <br />location of the new light poles. Mr. Chambers said the barrier wa11s create a very dark area which is <br />a safety hazard. The additional light poles are needed to ensure safety. <br />Mr. Malone said the hypericom shown on the landscape plan should be removed and spiraea magic <br />carpet used instead. He. asked if there would be landscape improvements to the site other than the <br />corner island. Mr. Chambers said the arborist recommended preserving a number of the trees. Mr. <br />Bohlmann asked where the sound barrier ended on the site and if a few panels could be removed. <br />Ms. Wenger said the sound barriers were included as part of the environmental documents for the <br />project. Between ODOT and County Engineering it's been indicated that every property owner <br />adjacent to the barrier walls would have to agree to have any panels removed. <br />Councilman Brossard said he was present to support the project and commend Mr. Chambers for <br />investing in the city. Mr. Harrington said his home abuts the northeast area of the parking lot and he <br />would prefer the fence not be installed along his rear property line and landscaping to be used <br />instead. Ms. Wenger said due to the proximity of the parking to the property line she would not <br />recommend eliminating the new fencing running north-south. Mr. Neff said the east-west fence <br />section would be eliminated. Mr. Rerko suggested evergreens be planted along that area in lieu of <br />fencing. <br />Mr. Malone moved, seconded by Mr. Bohlmann, to recommend BZA grant CMS 13-27 <br />Chambers Funeral of 29150 Lorain Rd the following variances: 1. A 9.16-foot variance for <br />rear yard setback (north parking); code requires a setback of 15 feet where abutting <br />residential property, applicant provides varying amounts between 5.5 feet to 5.84 feet, <br />Section 1139.07 table. 2. A 14.91-foot variance for side yard setback on a corner lot (east <br />parking); code requires 20 feet, applicant provides varying amounts between 5.09 feet to <br />17.82 feet, Section 1139.08, which passed 6-0. <br />Mr. Malone moved, seconded by Mr. Bohlmann, to approve the development plan for CMS <br />13-27: Chambers Funeral of 29150 Lorain Rd with the following conditions: <br />1. Lot consolidation is required. <br />2. Spiraea magic carpet will be used in the landscape plan. <br />3. The fence section which was to run east-west will be replaced with four Norway spruce <br />trees planted 6' to 8' tall, 20' apart. <br />4. Lighting is not to spill onto adjacent residential property.. <br />5. Flutter flags are to be eliminated. <br />Motion passed 6-0. <br />2
