time if the Charter amendment passes in November and to have the new board in place by <br />January the commission is being asked to review the zoning changes and make a <br />recommendation to Council now. Council will then complete their review of the legislation and <br />hold their vote until the November outcome. If the amendment fails the legislation will be tabled, <br />but if it's approved Council would have their third reading on the legislation the next day to <br />ensure everything is in place by January 2016. <br />Currently under Board of Zoning Appeals there are 14 code sections, the update would change <br />the code to 2 sections. Most of the new board will be structured under the Administrative Code <br />of the Codified Ordinances. Anything that is similar between the BBCA and BZA will fall under <br />one section to eliminate repetition and will ensure any future updates are not in conflict. The <br />sections which will be kept by the newly created Building and Zoning Board of Appeals, is the <br />sections relating to the conditions under which the new board would grant variances. Special <br />permits will be eliminated entirely as most of the sections are no longer applied. The newly <br />created chapter simplifies, streamlines and makes it easier for developers and staff'to understand <br />and follow. The board will retain the same power to hear variances from the Zoning and <br />Building codes. <br />Mr. Malone moved, seconded by Mr. Rerko, to recommend Council adopt ordinance 2015- <br />76, motion passed 5-0. <br />Ms. Wenger said the APA Cleveland Planning and Zoning Workshop will be held Friday, <br />November 13, 2015.
