within the front building setback. The applicant would like to follow the existing rear and front <br />setbacks of the dealership to ensure the curb appeal is cohesive, which she supports. Lot <br />consolidation is proposed and should be a condition of the Commission's approval. <br />Mr. Russell said a 12.93 foot variance for rear yard parking setback is needed, code requires 15 <br />foot and applicant shows 2.07 foot and a 55 foot variance for front yard setback for vehicle <br />display, code requires 75 foot, applicant shows 20 feet. Lighting is incomplete and may require <br />variances once a photometric plan is submitted. <br />Mr. Hanson said Ms. Wenger's report detailed the project well and asked if there were any <br />questions. Mr. Malone said along the west property line there are Norway spruce trees proposed <br />which will become too wide for the area. He requested the applicants use Pinus Abies Cupressina <br />which is a Columnar verity of the Norway spruce tree. The trees chosen should be installed 8 ft. <br />tall minimally. The area which abuts residentially used property should also be fenced using the <br />6 ft. tan vinyl fencing. The existing fencing is in poor condition and the vegetation is overgrown. <br />Mr. Hanson said that the site survey showed the board on board and chain link fences are owned <br />by the residents, not the dealership. Mr. Malone said the commission would like the applicants to <br />contact the homeowners to see if they would allow the dealership to remove the fences and <br />replace them with the 6 ft. tan vinyl fencing. If the neighbors chose to keep their fences the <br />applicants' fence will need to be 2 ft. from the abutting fence and include a gate as the area <br />between the fences will be maintained by the dealership. The commission will also require the <br />northwest light pole removed to ensure residents are not adversely impacted by the light. <br />Mr. Bohlmann noted the building official's report saying any light poles within 40 feet of <br />residential property could not exceed a 20 ft. height and lighting cut sheets are required. He said <br />the engineer's report states poured in place perimeter concrete curbing is required along the west <br />and north property lines. It also notes that irrigation is noted but not shown on the drawings. Ms. <br />Nader questioned the grading along the northern property and Mr. Hanson said the grading <br />wouldn't change from what is currently in place now. Ms. Nader noted the plans show a double <br />line around the perimeter of the site but the notes don't identify them as continuous concrete <br />curbing. She asked what would be between the two fences and how would the area be <br />maintained. Mr. Hanson said in lieu of grass they would gravel the area for easier maintenance. <br />Mr. Bohlmann noted all utilities are required to be run underground and all water and sanitary <br />connections are required to be capped at the right-of-way. Mr. Malone said meeting the <br />engineer's requirements will be part of approval. Mr. Henson said they would not require <br />variances for lighting, curbing or irrigation as they will meet code. Mr. O'Malley reviewed <br />updated codes which allow back to back fences and the applicant's responsibility to maintain the <br />area between the fences. He advised the commission that they could not require fence removal if <br />the fences are owned by the abutting property owners however they can encourage the applicant <br />to reach out to the fence owners and offer to replace their fence with the new 6 ft. vinyl fence. <br />Mr. Henry Gabriel said he has no objections to the board on board fence being removed and <br />replaced with a 6 ft tan vinyl fence. He's concerned about noise at the dealership. Currently they <br />are using the remote controls to set off the horns to locate cars location on the lot. He and other <br />neighbors have been to Council meetings with concerns as the horns are going off all day until <br />2
