+ . <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF MAY 4, 2015 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:05 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Laura Bellido, Bob Papotto, Eric Allain <br />Absent: Michael Raig <br />Staff: Assistant Building Commissioner Daniel Russell, Clerk of Commissions Donna Rote <br />RESIDENTIAL APPEALS AND REQUEST <br />APP15-3013: Sharon & Garv Moore; 28698 Spruce Road: <br />Proposal consists of a roof installed over the existing concrete patio. A 6 ft. rear yard variance is <br />requested, code requires 50 ft, applicant shows 44 ft., 1135.08(a). <br />The oath was administered to Sharon Moore and Bright Covers representative Adam Barnhart. <br />Ms. Moore said last year a large shade tree had to be removed from the backyard. Without a <br />cover over the existing 10' x 25' patio there is no shaae and the patio is rendered useless. The <br />cover would be 12' x 14' which covers just a little more than half the patio. She submitted <br />photos of her back yard. Mr. Allain asked when the patio was installed and Ms. Moore said the <br />patio and the fence were in place when the home was purchased. Mr. Allain asked why the <br />roof/cover required a variance but not the patio and Mr. Russell said the patio was not in <br />violation but the proposed roof/cover is as it's a permanent structure. Mr. Allain is concerned <br />that once the cover is approved the area could be converted into living space. He asked if a <br />retractable cover was considered a permanent structure, if not it could eliminate the need for a <br />variance. Ms. Moore said their home is one house from the end of the block, there are quite a few <br />trees in the area and on windy days branches and limbs get blown down. A retractable cover <br />would not be practical for the area. It is not their intent to convert the patio into a living space <br />they would just like to enjoy the use of their backyard. <br />Ms. Bellido moved, seconded by Mr. Allain, to grant APP15-3013: Sharon & Gary Moore <br />of 28698 Spruce Road a 6 ft. rear yard variance for installing a roof over existing patio, <br />code requires SOft, applicant shows 44 ft., 1135.08(a), which passed 4-0. <br />APP15-3015: Eric & Maria Puente; 23548 Westchester Drive: <br />Proposal consists of a pool and pool deck. A 109.5 sq. ft. variance for rear yard/lot coverage is <br />requested, code allows 1,044 sq. ft. applicant shows 1,153.5 sq. ft., 1135.02(d)(1), (d)(3). <br />The oath was administered to Eric and Maria Puente. Mr. Puente said they would just like to <br />build a deck to the preexisting pool. Ms. Puente said having a deck would provide an area around <br />the pool to have patio furniture and entertain around the pool. Ms. Rudolph asked how high the <br />deck would be as it appeared to be high and Mr. Puente said the deck would only be 26 inches <br />high. Mr. Allain said if the deck was reduced in size a variance wouldn't be required and Mr.
