-_ ? <br />BOARD OF ZONING APPEALS <br />CITY OF NORTH OLMSTED <br />MINLTTES OF JU1vE 1, 2015 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:00 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present:Jennifer Rudolph, Laura Bellido, Bob Papotto, Eric Allain, Michael Raig <br />Staff: Law Director Mike Gareau, Assistant Building Commissioner Daniel Russell, Clerk of <br />Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Ms. Bellido to approve the minutes of May 4, 2015 which passed 4-0. <br />Mr. Raig abstained. <br />RESIDENTIAL APPEALS AND REQUEST <br />APP15-3232: Yassir & Raiai Abu Ali; 6010 Forest Ridge Road: <br />Proposal consists of a fence in the front yard. The following variances are requested: <br />1. An 18 in. variance for placing a 4 ft. high fence in the front yard; code permits 30 in., applicant <br />shows 48 in., Secfion 1135.02(fl(1). <br />2. A variance for placing a solid fence in the front yard; code permits a fence 50% open, applicant <br />shows a solid white fence, Section 1135.02(fl(1). <br />The oath was administered to Rajai Abu Ali. Ms. Abu Ali said the section of fence was installed a month <br />earlier for privacy and protection. They have lived in their home for 11 years and they have had issues <br />with neighbors. They would like to be able to sit in their front yard and have some privacy. They were not <br />aware a permit was required for installing the section of fence. Ms. Rudolph asked if the structure was <br />considered a fence as it didn't enclose anything. Mr. Russell said what was installed is a fence and <br />reviewed Section 1135.02. Mr. Papotto said there are no regulations restricting tall evergreens or bushes <br />being installed for privacy. Ms. Abu Ali said she was not good with plants and the privacy fence ensures <br />privacy and security. Ms. Rudolph said she had no objections to the fence. The neighborhood wouldn't be <br />changed or adversely affected. <br />Ms. Rudolph moved, seconded by Ms. Bellido to grant APP15-3232: Yassir & Rajai Abu Ali of 6010 <br />Forest Ridge Road the following variances: <br />1. An 18 in. variance for placing a 4 ft. high fence in the front yard; code permits 30 in., applicant <br />shows 48 in., Section 1135.02(f)(1). <br />2. A variance for placing a solid fence in the front yard; code permits a fence 50% open, applicant <br />shows a solid white fence, Section 1135.02(f)(1) <br />Motion passed 5-0. <br />APP15-3311: Matthew V. Simoncic; 5770 Canterbury Road: <br />Proposal consists of a fence in the front yard. The following variances are requested: <br />1. An 18 in. variance for placing a 4 ft. high fence in the front yard; code permits 30 in., applicant shows <br />48 in., Section 1135.02(f)(1). <br />2. A variance for placing a fence in the front yard not 50% open; code permits a fence 50% open, <br />applicant shows a fence not 50% open, Section 1135.02(fl(1).
