SPECIAL BOARD OF ZONING APPEALS <br />CI'I'Y OF NORTH OLMS'TED <br />MINUTES OF JUleTE 22, 2015 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:08 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Laura Bellido, Bob Papotto, Eric Allain, Michael Raig <br />Staff: Law Director Mike Gareau, Clerk of Commissions Donna Rote <br />12EVIEW AND CORRECTION OF MINUTES <br />Mr. Raig moved, seconded by Mr. Allain, to approve the minutes of June 1, 2015, which <br />passed 5-0. <br />RESIDENTIAL APPEALS AND REQUEST <br />APP15-3164: Wendv Driver; 25027 Gessnea- Road: <br />Proposal consists of a fence. The following variance is requested: <br />1. A 27 ft. variance for installing a 6 ft. high solid board on board fence in the neighbor's 50 ft. <br />setback; code does not permit, applicant shows 23 ft., Section 1135.02(f). <br />The oath was administered to Wendy Driver. She lives on a corner lot and would like to fence in <br />the backyard. The fence will not impede pedestrian or vehicular traffic; neighbors have no <br />objections. It would be a board on board solid fence. Ms. Rudolph asked if the trees would be <br />inside the fence or outside and Ms. Driver said they would be within the fenced yard. Mr. Raig <br />noted that the fence would be 15 feet away from the neighbor's home and 23 feet off the <br />sidewalk. Members said it would not change the character of the neighborhood. <br />Mr. Papotto moved, seconded by Ms. Bellido, to grant APP15-3164: Wendy Driver of <br />25027 Gessner Itoad A 27 ft. varianee for installing a 6 ft. high solid board on board fence <br />in the neighbor's 50 ft. setback; code does not permit, applicant shows 23 ft., Section <br />1135.02(f), which passed 5-0. <br />APP15-3311: Matthew V. Simoncic; 5770 Canterbury Road: <br />Proposal consists of a fence in the front yard. The following variances are requested: <br />1. A 42" and 10" variance for a fence in the front yard; code permits 30", applicant shows 72" <br />and 40", Section 1135.02(fl(1). <br />2. A variance for placing a fence in the front yard that is not 50% open; code permits 50% open <br />fence, applicant shows both solid board on board and picket fence, not 50% open, Section <br />1135.02(fl(1). <br />Note: Continued from June 1, 2015 zoning meeting. <br />The oath was administered to Ms. Simoncic and neighbors John Horsfall and Tara Telzrow.
