?.? <br />property line to a 6' high privacy fence which will taper down to be a 4 foot picket fence. The 4' <br />fence will be 8' off the sidewalk and will enclose the front yard. Mr. Horsfall and Ms. Telzrow <br />were in favor of the south fence being a 6' solid fence but felt the 4' picket fence should be 25 <br />feet off the sidewalk. Ms. Simoncic said without any backyard the only place for her children <br />and dogs to be is in the front yard and the fence is needed for their security. Mr. Papotto asked <br />where the 6' fence would taper to 4' and Ms. Simoncic said the 4' fence would start 8' in from <br />the sidewalk. Mr. Allain and Mr. Papotto felt the 6' fence along the south was warranted but <br />believed the 4' sections of fence should be inward further from the sidewalk to keep the yard <br />from looking like a fortress. Ms. Bellido said the owners have tried to modify their fence to be <br />the least intrusive and abutting the commercial golf course she believes the south fence as <br />submitted is warranted but suggested the 4' sections of fencing could be 50% open to minimize <br />the impact of the front yard being fenced. <br />Ms. Rudolph moved, seconded by Mr. Raig, to grant APP15-3311: Matthew V. Simoncic of <br />5770 Canterbury Road a 42" and 10" variance for a fence in the front yard; code permits <br />30", applicant shows 72" and 4011, Section 1135.02(f)(1). Roll call: Rudolph, Bellido, Raig - <br />yes; Mr. Papotto, Mr. Allain - no, motion passed 3-2. <br />Ms. Rudolph moved, seconded by Mr. Allain, to grant APP15-3311: Matthew V. Simoncic <br />of 5770 Canterbury Road a variance for a fence in the front yard that is not 50% open; <br />code requires 50% open, applicant shows both solid board on board and picket fence, <br />which is not 50% open, Section 1135.02(f)(1). Roll call: Ms. Rudolph, Mr. Raig - yes; Ms. <br />Bellido, Mr. Allain, Mr. Papotto - no, motion failed 2-3. <br />COMMERCIAL APPEALS AND REQUEST <br />CMS15-3157 St. Richard/North Olmsted Middle School: 26855 Lorain Rd <br />Proposal consists of site modifications to temporarily relocate the North Olmsted Middle School, <br />the following variance is requested: <br />1. A 44 ft. variance for a rear yard setback; code requires 75 ft., applicant shows 31 ft., Section <br />1118.04(2). <br />The oath was administered to school representatives Michael McDade and Jeff Henderson. Mr. <br />Henderson said the variance is needed for the proposed modular units. The school district has <br />worked an agreement with St. Richards to house the middle school at their vacant school with <br />the addition of modular units to accommodate the total number of classrooms needed. The <br />variance is need for the placement of the modular units being less than 75 feet from the rear <br />property line. The units will be 31 feet off the property line. After three years the units will be <br />removed and the site restored. Board members had no objections to the request but discussed an <br />expiration date. <br />Ms. Rudolph moved, seconded by Mr. Papotto, to grant CMS15-3157 St. Richard/North <br />Olmsted Middle School of 26855 Lorain Rd a 44 ft. variance for a rear yard setback; code <br />requires 75 ft., applicant shows 31 ft., Section 1118.04(2), which will expire one year after <br />the school receives occupancy permit, which passed 5-0. <br />2
