A variance for a two-family residence in a Single Family C District; code does not allow, <br />applicant shows a two-family house, County records describe a single family dwelling; <br />Section 1135.01(a). 1123.12 use variance <br />The oath was administered to Robert Nagy, Realtor Russel Throne, and Resident Tim Nowak. <br />Mr. Nagy said the home seems to have been built in 1925 prior to any zoning codes. He <br />purchased the home 6 years ago and all his researching shows that the home has been a two <br />family home since it was built in 1925. He referenced his submittal which included letters from a <br />previous owner and neighbor who lived his entire life across the street from the house. It is <br />highly suggestive that it's been a two family residence as it would be very expensive to change it <br />from a single.family to a two family home. He is asking for a variance to allow the home to be <br />legalized as aitwo family residence in the single family zoning. Mr. Russell said the building <br />official submitted documentation pertaining to his ruling and said the main concern is the county <br />records has shown this to be a single family home as far back as their records exist. The <br />commissioner requested access to the home to verify if in fact the home was constructed as a <br />single family,?or a,two family home and Mr. Nagy denied him access to the home. Ms. Rudolph <br />asked how examining the home could help the building official determine whether the home was <br />once a single family home. Mr. Russell said the building official is an architect and both he and <br />the commissioner could determine if the home was altered to become a two family home. <br />Ms. Rudolph asked if there were any documents in the street file showing any permits for any <br />work done at the home and Mr. Russell said no. Mr. Russell said previous owners were cited and <br />told the home could not be used as a two family home, city records do not show this house as a <br />two family home. Mr. Nagy said a year ago when Mr. Grusenmeyer requested access to the <br />home he asked how that would help and he didn't think the building official gave him a <br />conclusive answer one way or the other. In looking through the city street files there was an <br />inspection conducted in 2001 regarding a prior citation. The inspector at that time did not make a <br />determination. Mr. Raig said when he visited the site the tenant invited him into the home. As a <br />retired contractor it was very clear that there had been multiple renovations made to the home. <br />Ms. Rudolph asked if the building department would have records of inspections for all homes <br />built in North Olmsted and Mr. Gareau said that is not the case it would depend on when the <br />home was constructed. He is not aware of the requirements of building a home in 1925, so <br />neither he nor the building official could speculate. Ms. Rudolph asked if there were any codes in <br />existence in 1925 and Mr. Gareau said the city has had ordinances in affect that date back to <br />1910 and he would think there were building codes in place at that time. County records state <br />that the home is a single family home and has been billed taxes based on the home being single <br />5
