<br />BOARD OF ZONING APPEALS <br />CITY OF NORTIH OLMSTED <br />MINiTTES OF OCTOBER 5, 2015 <br />ROLL CALL <br />Ms. Rudolph called the meeting to order at 7:00 p.m. in Council Chambers and led the Pledge of <br />Allegiance. <br />Present: Jennifer Rudolph, Laura Bellido, Bob Papotto, Eric Allain, Michael Raig <br />Staff: Law Director Michael Gareau, Jr., Assistant Building Commissioner Daniel Russell, <br />Clerk of Commissions Donna Rote <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Raig, to approve the minutes of September 14, 2015, <br />motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUEST <br />15-4296: Lawrence c& Denise Mohar; 5756 Barton Road <br />Proposal consists of a sunroom addition. The following variance is requested: <br />A 3 foot variance for rear yard setback to install a sunroom; code requires 50', applicant shows <br />47, section 1135.08(a). <br />The oath was administered to Lawrence and Denise Mohar. Mr. Mohar said the existing sunroom <br />is in poor condition and needs replacement. When the contractor went to pull permits for the <br />work he was told the original sunroom was constructed without permits and the new sunroom <br />required a variance. Mr. Allain asked if the footprint and foundation would be the same and Mr. <br />Mohar said the foundation is being replaced but the footprint is the same. Ms. Rudolph asked if <br />there would be heating or cooling in the room and Mr. Mohar said no just electricity for lights. <br />Ms. Rudolph moved, seconded by Mr. Allain, to grant 15-4296: Lawrence & Denise Mohar <br />of 5756 Barton Road a 3 foot variance for rear yard setback to install a sunroom; code <br />requires 50', applicant shows 47', section 1135.08(a), motion passed 5-0. <br />15-4452: Daniel & 19'Iargaret IZyan; 26734 Sudbury I)rive <br />Proposal consists of a shed and the following variances are requested: <br />l. A 40 sq. ft. variance for a shed; code permits 80 sq. ft., applicant shows 120 sq. ft., Section <br />1135.02(d)(1). <br />2. A 1 ft. variance for shed height; code permits 8 ft., applicant shows 9 ft., Section <br />1135.02(d)(1). <br />The oath was administered to Dan Ryan and homeowner association president Jerry Ramos. Mr. <br />Ryan said he would like a slightly larger shed than allowed. The area of his yard is 1 square foot <br />too small for the size shed he is requesting. Mr. Ramus said he supports the request. Members <br />felt the shed wouldn't adversely affect the neighborhGod.
