It would not be a <br />matter before the BZA to address unless they required variances. <br />Mr. Allain said the brochure shows samples of 4 ft., 5 ft., and 6 ft. gates and questioned why a 5 <br />ft. gate was chosen. Mr. Lasko said the 4 ft. gate was not available and the 5 ft. gate was chosen <br />to ensure the gate would be visible to both cars and trucks as soon as they turn down the <br />driveway. Mr. Allain questioned how the gates would be supported. Mr. Lasko said the <br />driveway is 15 feet wide, and the gates will be a total of 10 feet wide, with supporting posts <br />installed on either side of the driveway and the gates will open inward towards the owner's <br />home. <br />Mr. Allain said both the applicant and abutting neighbors each had valid points for and against <br />the gate. The property abuts the Metro Parks and a valid concern that once a gate is installed a <br />fence will come next, although that is not before the board. For most SUV's, trucks or vans to <br />visually see a gate over the hood of the vehicle it would need to be a minimum of 5 ft. high. Mr. <br />Papotto said the style of gate chosen is a classical look, will be more than 50% open, colored <br />black and will blend into the area. His only concern is signage being posted on the gates and <br />how deliveries would be made. Mr. Raig felt the need for the gate was valid as it would deter <br />random vehicles and will not adversely impact the neighbors or area. <br />Mr. Raig moved, seconded by Mr. Allain to grant 15-4718; Deborah Drossis of 23857 <br />Mastick IZoad Rear a 30 in. height variance for the height of a gate in the front yard; code <br />permits 30 in., applicant shows 60 in., Section 1135.02(f)(1), motion passed 5-0. <br />COMMERCIAL APPEALS AND REQiJEST <br />14-2222 Sunoco Gas Stataon; 28925 I.orain Road <br />Proposal consists of building modifications and site improvements. <br />A special permit to add to a non-conforming building is required, section 1165.02. <br />The following variances are required: <br />1. A 763 sq. ft. variance for lot coverage; code permits 3,298 sq. ft., applicant shows <br />4,061 sq. ft., Section 1139.05. <br />2. A 20 ft. variance for rear building setback; code requires 25 ft., applicant shows 5 ft., Section <br />1139.07. <br />3. A variance to enlarge a non-conforming building where the addition does not conform to lot <br />coverage and setback regulations, Section 1165.02(b)(1). <br />The oath was administrated to Architect Stephen Schill, and Owner Taniou Bougebrayel. Mr. <br />Schill said providing retail sales at gas stations axe a big part of their business. The station was <br />built in the early 70's. A previous owner sought similar variances in 2009 which were never <br />acted upon. The lot is less than a third of an acre therefore any improvement to the lot requires <br />variances.
