without a permit. The fence is an enhancement to the owner's yard as well as the neighborhood.
Mr. Merrell said prior to the sections of fence being installed he did speak with his neighbors
who had no objections. Mr. Raig questioned if the sections of fence were installed in the same
footprint and Mr. McMillon said the fence was installed 5 feet closer to the home. Board
members had no objections to the request.
Mr. Raig moved, seconded by Mr. Allain, to grant 15-4937; William Merrell of 4389
Danberry Drive the following variances for a fence:
1. A 30 in. variance for the height of a fence constructed on a corner lot, code permits 30
in., applicant shows 60 in., Section 1135.02(f)(2).
2. A variance for a solid fence constructed in the front building line of the neighbor's on a
corner lot, code permits 50% open, applicant shows solid, Section 1135.02(f)(1).
3. A variance for a 5 ft. high fence in a neighbor's front setback on a corner lot, code does
not allow, applicant shows a fence in the front setback on a corner lot, Section
1135.02(f)(2), Motion passed 5-0.
15-4946: Petru Bataran: 4642 Michael Ave.
Proposal consists of a new shed. The following variances are requested:
1. A 135 sq. ft. variance for new shed; code permits 120 sq. ft., applicant shows 255 sq. ft.,
Section 1135.02(d)(1).
2. An 3 ft. variance for shed height, code permits 9 ft., applicant shows 12 ft.,
Section 1135.02(d)(1).
The oath was administered to homeowner Petru Bataran, Son Chris Bataran, Eugene Barou and
neighbor Dan Barret. Chris Bataran said the existing shed was old and needed to be replaced.
Chris Batyaran submitted a new plan and said the size of the shed being requested was
decreased. The size of the shed will be 15'x13' instead of 17'x15'. The new shed will be in the
same location the previous shed was but the size of the new shed is slightly larger to store yard
tools, seasonal furniture, an ATV, power washer and other equipment. Once the storage shed is
finished they will have the ability to park their vehicles in the garage. His neighbors have no
objections to the variances required, which is shown on the letter submitted. Nor will the new
shed adversely affect the neighborhood. The foundation which was installed will be slightly
larger than the shed to allow a small seating area. Mr. Bataran said he asked his son to speak for
him as his English is limited. They would like a new shed so they can store their outdoor items.
Mr. Barret said his neighbor didn't ask his opinion of the shed. He called the city when he saw
the old shed was removed and a new foundation was installed that looked to have been moved
right up to the rear property line. He believes the size of the shed is excessive and a 12' height
would adversely impact him. Chris Bataran said the shed will be smaller than first submitted and
the height will only be 10' tall from the base of the shed to the peak of the roof. The foundation
which he replaced was due to animals digging under the foundation of the previous shed. Mr.
Russell said he had no abjections to the newly proposed 15'x13' shed. The applicant will now
require a 75 sq. ft. variance for the size of the shed, code permits 120 sq. ft. and 195 sq. ft. is
shown on the new plan. Depending on how the height is being measured the applicants may not
require the height variance. To address the neighbors concern about the placement of the shed,
the plans show that the shed will be placed 10' off the rear property line and 20' from the
northern side yard lot line and 25' from the southern side yard line which is within code. Ms.
Rudolph questioned how the applicant measured the height of the shed and Mr. Bataran said he
