Stortnwater quality control shall be provided per city requirements. <br />5. Stormwater quantity control is required. To address the deficiencies in minimum required <br />storage volume, and maximum allowable peak discharge rates currently proposed in the <br />plans, the applicant shall reduce the peak discharge leaving the site by the excess 69 cfs. The <br />100-year flood water elevation within the site shall be reduced by four inches, or 248,000 cf <br />of storm water storage shall be added to account for the excess peak flow for duration of one <br />hour. <br />6. A consolidation plat shall be prepared combining the existing five separate parcels. <br />7. A conservation easement shall be prepared to protect the riparian setback. It shall be shown <br />on the consolidation plat. <br />8. The proposed fence currently shown along Roots Ditch shall be removed from the riparian <br />setback. <br />9.. A variance to 926.12 (LJses Prohibited in Riparian and Wetlands Setbacks) is recommended <br />contingent upon the applicant incorporating permeable pavers and/or bioretention to address <br />the new impervious surfaces within the flood plain and riparian setback, in accordance with <br />926.14. <br />Mr. O'Malley agreed that the CUP should be addressed at this meeting. The property has been <br />used as a school facility for decades so it likely meets the conditional use permit details, but the <br />PDC is authorized to impose other conditions to it. The riparian setback variance is considered <br />by City Council, not BZBA, although the PDC can make their recommendations in the same way <br />they would be for BZBA. <br />Mr. Smith thanked the staff for their willingness to work with the schools to do a phased design <br />project. They are prepared to meet the conditions required by the Engineer even though it will <br />increase cost for the project. Mr. Malone pointed out that most of the conditions given by Mr. <br />DiFranco are requirements of the EPA for the City's NPDES stormwater permit or other state <br />and federal agencies. Mr. Anderson was concerned about an agreement being in place for <br />widening the roadways with the City. Mr. Smith stated that they will be coming back to get <br />permission for the off-site ROW work that will be done according to the traffic study that will be <br />submitted. Mr. Anderson questioned if the approved setback would be affected if the road is <br />widened. Ms. Wenger clarified that all of the road improvements would be done within the <br />existing right-of-way. The setbacks are measured from property lines and ROW lines so the <br />changes would not change the distance between the setback and the face of the building. <br />Mr. James Faia, 5935 Burns, was concerned about his property being acquired in the future by <br />the school district. He also asked if his property would still be considered to be in the flood zone. <br />Mr. DiFranco stated that the raising of the flood plain on the school property could affect the <br />hoineowner's property but the City will be taking extra caution to ensure abutting properties are <br />not adversely affected. <br />Mr. Malone moved, seconded by Mr. Anderson, to approve a conditional use permit for 16- <br />5426; N.O.
