BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />1VIINUTES OF SEPTEIVIBER 12, 2016 <br />ROLL CALL <br />Vice Chairman Allain called the meeting to order at 7:00 pm in Council Chambers and led the <br />Pledge of Allegiance. <br />Present: Bob Papotto, Melissa Meredith, Eric Allain, Donna Sabo <br />Absent: Michael Raig <br />Staff: Law Director Michael Gareau, Assistant Building Commissioner Dan Russell, Planner <br />James Aspery, Administrative Assistant Nicole Rambo <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Papotto moved, seconded by Mr. Allain, to approve the Builcling & Zoning Board of <br />ELppeals minutes of August 1, 2016, motion passed 3-0, Ms. Sabo abstained. <br />RESIDENTIAL APPEALS AND REQUESTS <br />16-6811; James Yost; 5772 Porter Road <br />Representative: James Yost, Owner <br />Proposal consists of a 4 ft. high fence. The property is zoned One Family Residence B. <br />The following variances are required: <br />1. An 18 in. variance for 4 ft. chain link fence installed in the front building setback of the <br />abutting lot on the side street; code permits 30 in., applicant shows 48 in., Section <br />1135.02(fl(1). <br />2. A variance for 4 ft. high fence located on a corner lot within the front building setback of the <br />abutting lot on the side street; code does not allow, applicant shows a 4 ft. high fence on a <br />corner lot within the front building setback of the abutting lot, Section 1135.02( fl(2). <br />Mr. Aspery stated that the property is at the intersection of Porter Road and Midvale Avenue <br />with frontage on Porter Road, and the applicant has requested a variance to allow a 4 ft. chain <br />link fence installed in the front building setback of the abutting lot on the side street. Code allows <br />up to a 30 inch fence, and the applicant exceeds this by 18 inches. A variance is also requested <br />for a fence on a corner lot within the front building setback of the abutting lot. Code prohibits <br />any fence on a corner lot from being installed in the front building setback of the abutting lot. <br />Mr. Yost stated that the existing fence was there when he purchased the home 21 years ago. The <br />fence would protect his gardens and small dogs. The fence is not visible from Porter and Midvale <br />due to trees and landscaping obstructing the view. Due to the layout of their yard, complying <br />with the code would drastically decrease the amount of usable yard space the applicant would <br />have. Ms. Meredith stated that she did not believe the current owner should bear the <br />responsibility for the previous owner's mistake of not getting a variance for the fence. Ms. Sabo <br />and Mr. Allain believed that the applicant met the standards for hardships.
