Ms. Meredith moved, seconded by Mr. Papotto, to grant the following variances as written <br />for 16-6811; James Yost; 5772 Porter Road: <br />1. An 18 in. variance for 4 ft. chain link fence installed in the front building setback of the <br />abutting lot on the side street; code permits 30 in., applicant shows 48 in., Section <br />1135.02(f)(1). <br />2. The property <br />is zoned One Family Residence C. <br />The following variance is required: <br />1. A variance for a residential accessory use with no permitted main use; code does not allow, <br />applicant shows a swimming pool on a vacant parcel of land; Sections 1135.01(a), <br />1135.02(i). <br />Note: Owners purchased two contiguous parcels of property. House and garage are located on <br />PPN 237-15-043. Pool is proposed on PPN 237-15-045. <br />Mr. Aspery stated that the applicant is requesting to install a new swimming pool on a parcel <br />without a permitted main use. Per code, a permanent swimming pool is permitted as an accessory <br />use to a dwelling. Ms. Hemann stated the packet included deed information back to 1972. She <br />stated that the deeds appear to be reciprocal and are used as collateral for the other properties. <br />The cost of consolidating the parcels would be similar to that of the pool installation and would <br />be cost prohibitive.
