fence on a corner lot within the front building setback of the abutting lot, Section
1135.02(f)(2).
Mr. Aspery stated that the property is at the intersection of Southern Avenue and Mackenzie
Road with frontage on Southern Avenue, and the applicant has requested a variance to allow a 5
ft. chain link fence installed in the front building setback of the abutting lot on the side street.
Code allows up to a 30 inch fence, and the applicant exceeds this by 30 inches by showing a 60
inch fence. A variance is also requested to allow a fence on a corner lot within the front building
setback of the abutting lot, which code prohibits.
Ms. Norton stated that she needs a fenced in yard for her dog. Mr. Clause added that the
applicant has a golden retriever so a taller fence is necessary. He added that the fence would be
permitted if it was not on a corner lot. Ms. Meredith was concerned about the height and color of
the fence, she believed a wood fence would look more appealing than a chain link fence. Ms.
Meredith noted that she did not have an issue with a fence being installed on the property.
Ms. Meredith moved, seconded by Mr. Allain, to grant the following variances as written
for 16-6927; Beverly Norton; 6105 Mackenzie:
1. A 30 in. variance for a 5 ft. high chain link fence in the front building setback on a
corner lot; code permits 30 in., applicant shows 60 in., Section 1135.02(f)(1).
2. A variance for a 5 ft. high fence located on a corner lot within the front building setback
of the abutting lot on the side street; code does not allow, applicant shows a 5 ft. chain
link fence on a corner lot within the front building setback of the abutting lot, Section
1135.02(f)(2).
Motion passed 4-0.
16-6961; Edward & Janet Cave; 6065 Paisley Drive
Representative: Edward Cave, Owner
Proposal consists of a fence in the rear yard. The property is zoned One Family Residence B.
The following variance is required:
1. A 10 in. variance for a fence installed in the rear yard; code permits 6 ft., applicant shows
6 ft. 10 in., Section 1135.02(fl
Mr. Aspery stated that the applicant is requesting a variance to allow a proposed fence to exceed
code by 10 inches for a segment along the southern property line, running parallel to an existing
neighboring fence. Code allows up to a 6 foot fence, applicant shows 6 foot 10 inches.
Mr. Cave stated that the back of his property slopes down due to a natural waterway that runs
through the area. The requested variance would allow the fence to appear level around his
property and let water pass through without damaging the fence. The proposed fence would be 8
ft. from the back property line to allow for the water to run naturally.
Richard Schmidt, neighbor, stated that the fence is a solid panel fence and is very intimidating.
He said the vinyl fence is 2 feet in from the applicant's property line and his existing chainlink
fence. He added that he believed the contractor should be held responsible for the improperly
installed fencing since a permit was pulled. Mr. Schmidt offered to have his chain link fence
