A variance to use an exposed foundation material that does not match the existing <br />foundation materials on a new addition; code permits brick to match existing brick <br />facade, applicant shows smooth stucco, Section 1305.03(a)(2). <br />Motion passed 5-0. <br />16-5446; Teresa Miller: 24057 Lebern Drive <br />Representatives: Teresa Miller, owner; Tom Miller, 23375 Emmons Road, Columbia Station <br />Proposal consists of a 6 foot white vinyl solid fence. The following variances are requested: <br />1. A variance for a 6 ft. high fence located on a corner lot within the front building setback of <br />the abutting lot on the side street; code does not allow, applicant shows a 6 ft. high fence on a <br />corner lot within the front building setback of the abutting lot, Section 1135.02(f)(2). <br />2. A variance for a privacy fence which extends nearer the street line than the front building <br />line; code permits a 50% open fence, applicant shows solid, Section 1135.02(fl(1). <br />3. A 42 in. variance for a 6 ft. high fence which extends nearer the street line than the front <br />building line; code permits 30 in., applicant shows 72 in., Section 1135.02(f)(1). <br />Ms. Wenger stated that the zoning is One Family Residence C. The property is at the intersection <br />of Lebern Drive and Hawkins Road with frontage on Lebern. The existing chain link fence <br />would be removed. The new 6 foot high white vinyl fence would be installed from the rear <br />corner of the original house along Hawkins to the rear property line. The residential property <br />abutting to the south has frontage and access onto Noreen, not Hawkins, so that Hawkins acts as <br />a side yard to the abutting property rather than a front yard. The proposed fence is to be located 6 <br />feet off the sidewalk. Ms. Miller stated that the existing chain link fence is in disrepair and <br />causes issues for her dog. The proposed fencing would match the neighbor's fence and would be <br />extended to enclose the air conditioning unit to block foot traffic cutting through the property. <br />Ms. Wenger said the fence would not obstruct the neighbors since the homes are back to back, <br />which is unusual for a corner lot. Ms. Thomas clarified that the fence would not extend past the <br />front of the house. Mr. Russell stated that the fence would be measured from the property <br />owner's grade, not the sidewalk which would include the retaining wall. Ms. Thomas stated that <br />there will be a gap between the proposed fence and the sidewalk in which she would plant <br />bushes. Ms. Meredith was concerned that the fence would look too tall from the sidewalk and <br />believed a similar look could be achieved that would be more compliant. Ms. Thomas stated that <br />the top of the fence would line up with the neighbor's fence. Mr. Raig pointed out that from the <br />sidewalk, the fence would appear to be 7.5 foot tall due to the retaining wall. <br />Ms. Meredith moved, seconded by Mr. Allain, to grant as written 16-5446; Teresa Miller; <br />24057 Lebern Drive to build a 6 foot high white vinyl solid fence with the following <br />variances: <br />1.
