BUILDING & ZONING BOARD OF APPEALS <br />CITY OF NORTH OLMSTED <br />MINUTES OF MAY 2, 2016 <br />ROLL CALL <br />Chairman Raig called the meeting to order at 7:00 pm in Council Chambers and led the Pledge <br />of Allegiance. <br />Present: Eric Allain, Michael Raig, Bob Papotto, Melissa Meredith, Donna Sabo <br />Staff: Law Director Michael Gareau, Assistant Building Commissioner Dan Russell, Planner <br />James Aspery, Administrative Assistant Nicole Rambo <br />REVIEW AND CORRECTION OF MINUTES <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the Building & Zoning Board of <br />Appeals minutes of April 4, 2016, motion passed 5-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />16-5556; James Held; 7041 Warrington Drive <br />Representatives: James Held, owner; Norman Althen, owner <br />Proposal consists of a deck. Zoning is One Family Residence A. <br />The following variance is requested: <br />1. An 18 in. variance for the deck height off grade to be exempt from the 2013 Residential Code <br />of Ohio; code requires 30 in., applicant shows 48 in., Section 102.10.9 RCO. <br />Mr. Russell stated that the proposed deck is for a rental property. The deck was built without a <br />permit and was not built to code. The height does not comply with code, so if a variance was <br />granted, a permit would not be required and the deck would not need to be torn down. Mr. Held <br />stated the tenant has a special needs daughter who uses the pool for therapy. The deck was built <br />higher to have easier access to the pool. Mr. Held said the tenant, who is a carpenter, built the <br />deck. Mr. Russell said a permit was pulled for the pool and electrical prior to the deck being <br />built. Ms. Sabo asked if a ladder could be installed to provide pool access. Mr. Held stated that it <br />would be an inconvenience for the daughter. Ms. Meredith asked about the safety of the deck, <br />Mr. Russell stated that he was not sure about the safety, but it does not comply with code. She <br />clarified that the issue at hand was about the deck foundation. Mr. Raig was concerned about the <br />handrails being properly installed if no permit and inspections are required. Mr. Gareau said the <br />variance can be contingent upon handrails being installed. <br />Ms. Sabo moved, seconded byMr. Allain, to grant the following variance for a deck for 16- <br />5556; James Held; 7041 Warrington Drive, contingent upon handrails being installed in <br />accordance with state building code requirements: <br />1. An 18 in. variance for the deck height off grade to be exempt from the 2013 Residential <br />Code of Ohio; code requires 30 in., applicant shows 48 in., Section 102.10.9 RCO. <br />Motion passed 5-0.
