Zoning is One Family Residence A. <br />Note: Applicant was denied a variance for 6 ft. fence 4/4/16. <br />The following variances are requested: <br />1. A variance for a solid fence in the front building setback; code requires 50% open fence, <br />applicant shows a solid fence, Section 1135.02(f)(1). <br />2. An 18 in. variance for a 4 ft. high solid fence in the front building setback; code permits 30 <br />in., applicant shows 48 in., Section 1135.02(f)(1). <br />3. A variance for a 4 ft. high fence located on a corner lot within the front building setback of <br />the abutting lot on the side street; code does not allow, applicant shows a 4 ft. high fence on a <br />corner lot within the front building setback of the abutting lot, Section 1135.02(f)(2). <br />Mr. Aspery said the existing fencing will be removed. A new solid wood 4' high fence would <br />enclose most of the back yard area. The applicant lowered the fence by 2' from their previous <br />submission, leaving the fence composition unchanged. A setback of 21 feet from the sidewalk is <br />proposed. Code allows a fence in the front building setback (50 feet) so long as it is 50% open <br />and no more than 30 inches high. Ms. Morales stated that the fence line was moved back 6 more <br />feet from the sidewalk, a total of 21 feet is proposed now. The fence was also shortened by 2 <br />feet. The sideyard is essentially their backyard due to the layout of the property. They could not <br />change the fence location because they need the full yard area for family gatherings and would <br />have to remove existing landscaping. The privacy fence is needed due to the yard layout and to <br />keep people out of their yard. Both of the owners' work schedules are unpredictable, so they do <br />not want the dogs to be barking at traffic or wildlife at all hours. The fence would extend 12 feet <br />from the existing 6' fence with the 4' fence. The 4' fencing would be board on board to continue <br />the 6' fence style. Mr. Papotto said significant changes were made from previous proposal. Mr. <br />Allain said he does not like fences in the front yards, but this is an unusual case. <br />1VIs. Meredith moved, seconded by Mr. Allain, to grant the following variances for a fence <br />for 16-5621; Andy & Lisa Morales; 5113 Park Lane: <br />1.
