Mr. Neville stated that the <br />Landmarks Commission was created to preserve what the district already has, as opposed to <br />changing what has already been done. Mr. Wasniak stated that most painting contractors will <br />charge extra to deal with the lead abatement most likely necessary to paint his home. Mr. <br />Dubelko and Mr. Neville disagreed that the lead abatement issue is a hardship for the applicant. <br />Mr. Dubelko clarified that the proposal is for installing vinyl siding for the entire house. <br />Mr. Dubowski moved, seconded by Mr. Dubelko, to approve a Certificate of <br />Appropriateness for new vinyl siding for CMS15-5017: James Wasniak; 26487 Butternut <br />Ridge ltoad, motion denied 0-5. Mr. Limpert commented that the standards evolve over <br />time and in this case he believes the change should be denied. Mr. Dubowski said that he is <br />in favor for the least amount of maintenance but in this case he is bound by the regulations. <br />Ms. Schuler asked about recourse if an applicant goes forward with doing work that was denied <br />by the Commission. Ms. Wenger stated that the Building Department would be responsible for <br />enforcement since the applicant would be unable to pull a permit for the work. <br />27111 Butternut Ridge Road <br />Stone and wood landscape wall <br />Ms. Wenger stated that the wall has been shown to be in the City ROW from the owner's survey <br />dated 2012. She stated that the City is not necessarily responsible to maintain the wall. Mr. <br />Dubelko said the deed from 1959 states that the past owner only got part of the lot with a two <br />foot arc-shaped area carved out. Ms. Wenger described Council's legislative process for allowing <br />new neighborhood identification signs in the right-of-way. Long term maintenance has been an <br />issue in the past. She added that the wall is not being used as a sign. Mr. Dubowski clarified that <br />the sign was built in the late 1950s. Mr. Neville believed it is an interesting artifact but may not <br />be of historic value to the district. Mr. Limpert suggested that they could ask the residents of the <br />neighborhood if they want to keep or improve the wall to use as identification but speculated as <br />to who would bear the cost of improvement. Mr. Dubelko stated that the wall should be taken <br />down as it is a remnant of a failed project. Ms. Schuler and Mr. Dubowski had no objection. Mr. <br />Limpert believed the wall needs to be maintained or be demolished and Mr. Neville agreed. Mr. <br />Limpert added that once the wall is removed it may be a missed opportunity for the <br />neighborhood. <br />Mr. Dubowski moved, seconded by Ms. Schuler, that the Landmarks Commission does not <br />object to the removal or repair of the landscape wall at 27111 Butternut Ridge Road, <br />motion passed 5-0. <br />2015 Annual Report <br />Ms. Wenger stated that the goals in the report do not have to be accomplished this year and <br />added that the list could be added to the future agendas to be discussed at meetings. <br />Mr. Limpert moved, seconded by Mr. Dubowski, to approve the 2015 Landmarks <br />Commission Annual Report, motion passed 5-0.
