It is my intent to submit the legislative request for <br />introduction to City Council at their March 215t meeting. <br />Chapter 1139 Chanqes <br />• Modification of language in 1139.03 to specify that an approved principal structure is <br />required for any use of land. This would prohibit selling merchandise on a vacant lot or on <br />a lot with a vacant structure that is not occupied as part of the business operation. <br />• Added convention, banquet and meeting facilities as conditional in B-2. <br />• Removed equipment rental from automotive section and placed in offices and services. <br />• Updated permitted versus conditional designations in development and testing laboratories, health and fitness clubs, and medical and dental laboratories. <br />• The purpose statement of B-2 described the current mix of residential and business uses <br />in the district, but the use table did nothing to promote or allow most types of residential <br />development. Furthermore, all existing homes in B-2 would have been made non- <br />conforming with the update. Therefore, I've added senior housing and existing single <br />family dwellings to the B-2 district. Discussion: Is there any other business district where <br />senior housing might be a conditional use? <br />• Reduced permitted height in B-4 Mixed-use Business from 5 stories (60 ft) to 4 stories <br />(50 ft). Concern was expressed by residents in the adjacent residential neighborhood <br />regarding height. The proposed residential density of 12 units per acre could be <br />accommodated by 4-story buildings, according to our consultant, so I propose this <br />change. Also the mixed use redevelopment process operates more like a planned unit <br />development so staff and the PDC can ensure in design review that there is appropriate <br />transition in scale between residential areas andmixed use areas. <br />• In 1139.05, I restructured the Street Lawn standards into three subsections: depth, plant <br />materials and street lawn design.
