it is connected to the garage. There will be no roof on the structure. Ms. Abughali stated that they
have lived in North Olmsted for many years and raised their family here. They want to have
something nice for their home. They would do whatever it takes to ensure the structure's safety.
Mr. Pavlosky believed the pergola improves the applicant's property value and his own. The
pergola is not on his property and he has no objections.
Mr. Mackey asked if a building inspector has inspected the pergola, Mr. Russell stated that an
inspection will be done once a permit is issued. Mr. Allain and Mr. Papotto believed the
hardships were met. Mr. Papotto added that the pergola looks nice. Mr. Raig pointed out that the
lot is oddly shaped.
Mr. Allain moved, seconded by Mr. Mackey, to grant the following variances for 17-8029;
Mohamed Ali & Nazha Abughali; 5464 Jacqueline Lane:
1. A 1 ft. variance for side yard setback; code requires 5 ft., applicant shows 4 ft., Section
1135.07.
2. A 6 ft. variance for combination of side yards with an attached garage; code requires 15
ft., applicant shows 9 ft., Section 1135.07.
Motion passed 4-0.
17-8263; Kathv Allen; 28574 Magnolia Drive
Representative: Kathy Allen, owner
Proposal consists of a 10 x 14 ft. shed in the rear yard. The property is zoned One Family
Residence B. The following variance is requested:
1. A 20 sq. ft. variance for a shed; code pernuts 120 sq. ft., applicant shows 140 sq. ft., Section
1135.02(d)(1).
Mr. Aspery stated that the applicant is requesting a variance to allow a 140 square foot shed in
the reax yard. Code allows for an accessory structure up to 120 square feet based on lot size,
requiring a variance of 20 square feet for the proposed shed. All rear lot line setback and height
requirements have been met as indicated in submitted plans.
Ms. Allen stated that she is currently renting a storage unit and would like to get a larger shed to
accommodate her stuff. There is not much extra space in the garage with two cars in it or in her
split-level home. Mr. Papotto clarified that the plans would need to comply with the nine foot
height. Mr. Allain believed the shed would fit in with the character of the neighborhood. Mr.
Papotto added that the property is well maintained and seemed organized so he did not think the
request was unreasonable.
Mr. Allain moved, seconded by Mr. Papotto, to grant the following variance for 17-8263;
Kathy Allen; 28574 Magnolia Drive: .
1.
