Proposal consists of an attached deck in the rear yard. The property is zoned One Family <br />Residence A. The following variances are requested: <br />1. A 24 ft. 6 in. variance for rear yard setback for a deck; code requires 50 ft., applicant shows <br />25 ft. 6 in., Section 1135.08(a). <br />2. A special permit is required to add to a non-conforming building, Section 1165.02. The <br />existing house encroaches into the required rear yard setback. <br />The applicant is requesting a variance of 24.5 feet to allow for the addition of a deck 18 feet in <br />width by 16 feet in depth to the rear of their existing home. The current rear yard setback is 41.5 <br />feet, which is already a nonconforming distance, and the proposed deck would further reduce this <br />setback number to 25.5 feet. Code requires a rear yard setback of no less than 50 feet. The <br />applicant is also requesting a variance to allow for an addition to a currently non-conforming <br />building. Code requires that a nonconforming building not be altered, added to or enlarged unless <br />the additions and original buildings are made to conform to the setback, requirements of the <br />district in which it is located. <br />Mr. Weinberg stated that the rear of the property borders Westlake and does not back against any <br />other North Olmsted properties. The plans have been approved by the Building Department, <br />pending the approval of the variances. Mr. Raig clarified that there is a creek on the Westlake <br />side and a home is beyond that. Mr. Allain believed the lot is unique. Mr. Papotto pointed out <br />that a variance would be required for any proposed project. Mr. Raig did not believe any other <br />property owners would be infringed upon by granting the variances. <br />Mr. Allain moved, seconded by 1VIr. Raig, to grant the following variances for 17-8310; <br />Thomas Weinberg; 27948 Blossom Lane: <br />1. A 24 ft. 6 in. variance for reaa- yard setback for a deck; code requires 50 ft., applicant <br />shows 25 ft. 6 in., Section 1135.08(a). <br />2. A special permit is required to add to a non-conforming building, Section 1165.02. The <br />existing house encroaches into the required rear yard setback. <br />Motion passed 4-0. <br />COMMERCIAL APPEALS AND REQUESTS <br />17-8281; Universitv Hospitals; 26127 Lorain Road <br />Representative: Brad Petro, 4330 North Bend Road, Ashtabula, OH <br />Proposal consists of signage. The property is zoned General Retail Business. The following <br />variances are requested: <br />1. A 119 sq. ft. variance for excessive sign face axea on a building; code allows 108 sq. ft., <br />applicant shows 227 sq. ft., Section 1163.25(b). <br />2. A variance for 2 additional wall signs; code permits 2, applicant shows 4, Section 1163.28(a). <br />3. A 2 ft. 8 in. variance for the height of a wall sign (UH logo sign on north elevation); code <br />permits 4 ft., applicant shows 6 ft. 8 in., Section 1163.28(c). <br />Mr. Aspery stated that the applicant is requesting multiple variances to install nonconforming <br />wall signage on the new University Hospitals clinic building.
