1. A 5 ft. variance for rear property line setback; code requires 10 ft., applicant shows 5 <br />ft., Section 1135.02(c)(3). <br />2. A 5 ft. variance for side and rear setbacks from a dwelling on both adjacent lot (south <br />and east); code requires 15 ft., applicant shows 10 ft., Section 1135.02(c)(2). <br />Motion passed 4-0. <br />COMMUNICAT'IONS <br />17-8319; Northern View Villas; 4879 Columbia Road <br />Ms. Wenger reviewed the status of the case, which was erroneously sent before the BZBA <br />because the sign was proposed to be on public property, not private property. The sign should be <br />treated similar to a development sign and was sent for City Council approval to use the land. <br />Zoning Code Update <br />Ms. Wenger thanked Mr. Papotto for participating on the zoning update committee. She <br />reviewed the zoning code updates. The biggest change concerning the BZBA is that development <br />plans requiring variances will need to be approved by BZBA prior to going to PDC for final <br />approval. The Planning Department will take care of the write ups for the commercial projects <br />and the Building Department will handle the residential write ups. More conditional uses have <br />been created with specific standard and City Council will have the ability to waive the standards. <br />The PDC has the right to modify of waive landscaping, buffering or building materials. The <br />parking and loading chapter allows PDC to modify parking spaces and curb cuts. These have <br />been changed to keep variances from being granted that they do not want running with the land <br />in perpetuity. Amendments to the zoning code will be requested from City Council as necessary. <br />All new businesses are required to get a certificate of zoning compliance to ensure the business <br />type is permitted in that district. The zoning map has also been updated to reflect the changes. <br />The rest of the code has been reformatted to match the updated sections. The codified ordinances <br />will be updated on the City's website in July. <br />Chapter 1135 will be going to Council for update approval in August, including corner lot fences <br />and shed regulations. Requirements for front yard lot coverage and driveways have been added. <br />No properties will be rezoned in the update. The mixed use chapter will also be updated in the <br />future.
