in order for the applicant to expand on a nonconforming building, code requires that the
alterations conform to all applicable setback requirements. In this instance, the existing building
was granted a rear yard setback variance during the original construction that permitted a rear
yard setback of 50 feet. A variance is required permitting the applicant to make nonconforming
alterations to the already-nonconforming building, an addition that does not comply with this 75-
foot setback. Regarding the first variance listed, code also requires a special permit as part of this
process permitting a nonconforming alteration to a building.
Mr. Swidrak said the purpose of the project is to increase the space for the children's ministry
and concentrate the kids into one area and increase security. The addition would include offices
in the lower level and another children's space on the second floor. The project would not
increase the church attendance or parking spaces. Discussion about factors limiting expansion in
other directions such as lot shape and setback requirements. Mr. Aspery stated that the applicant
eliminated the need for other variances during the planning process. Mr. O'Malley pointed out
that the building is non-conforming by being less than 75 feet from the rear yard. Mr. Papotto
ensured that the curb will remain in the same place along Great Northern Boulevard. Mr. Allain
believed the lot shape necessitates the variance.
Mr.l2aig moved, seconded by Mr. Allain, to grant the following variances for 17-8432;
North Olmsted Evangelical Friends Church; 5665 Great Northern Boulevard, as amended:
1. A special permit to add to a non-conforming building, Section 1165.02(b)(1).
2. A variance to add to a non-conforming building where the addition does not conform to
the 75 ft. rear yard setback; applicant shows addition within rear yard setback of 75 ft.,
Sectiom 1165.02(b)(2).
3. Contingent on the development plan being developed as presented.
Motion passed 4-0.
ADJOURNMENT
With no further business the meeting adjourned at 8:06 p.m.
Michael Raig, Chair
Nicole Rambo-Ackerman, Administrative
Assistant
Approved:
