Mr. Raig was in support of the application. Mr. Mackey noted that the owner provided a letter <br />showing signatures of the neighbors showing no objections to the project. He did not think it <br />would measurably alter what is already there. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 18- <br />12349; Thomas & Donna Harlan; 24735 Deerfield Drive: <br />1. A variance for a detached accessory structure (deck) in the side yard; code requires <br />accessory structures to be located in rear yards only, applicant shows an accessory <br />structure (deck) in the side yard; Section 1135.02(C)(1). <br />Motion passed 4-0. <br />18-12447; Mark & Linda Obral; 4390 Birch Circle <br />Representatives: Mark Obral <br />Proposal consists of a roof over a concrete patio. Property is zoned C-One Family Residence. <br />The following variance is requested: <br />1. A 6 ft. variance for roof structure encroaching into required rear yard; code requires 50 ft. <br />setback, applicant shows 44 ft., Section 1135.06(D). <br />Mr. Aspery said the applicant is proposing to install a roof structure over an existing concrete <br />pad to the rear of their home. The proposed structure would create a rear setback of 44 feet. The <br />structure does not appear to be enclosed, but code still requires that the depth of a rear yard be <br />determined at the point of least distance from any part of the dwelling, which includes this roof <br />structure, to the adjacent rear lot line. <br />Mr. Obral said the house is over 50 feet from the rear property line. He wanted to install the roof <br />to block the view of the hotel patrons and to block the sun during the summer. He did not think <br />the commercial neighbors would mind if the roof was installed. Mr. Papotto ensured that the <br />patio structure would not be enclosed later on, Mr. Obral said that is not planned at this time. Mr. <br />Papotto said the patio is existing and the neighbors would not be impacted due to the proposed <br />structure's location, Mr. Rahm and Mr. Mackey agreed. <br />Mr. Papotto moved, seconded by Mr. Raig, to approve the following variance for 18-12447; <br />Mark & Linda Obral; 4390 Birch Circle: <br />1. A 6 ft. variance for roof structure encroaching into required rear yard; code requires <br />50 ft. setback, applicant shows 44 ft., Section 1135.06(D). <br />Motion passed 4-0. <br />18-12511; Cindv Eckstein; 5887 Park Ridge Drive <br />Representatives: Cindy Eckstein <br />Proposal consists of a fence in the front yard. Property is zoned B-One Family Residence. <br />The following variances are requested: <br />1. An 11 inch variance for fence height; code allows 30 in. maximum height in a front yard, <br />applicant shows 41 in.; Section 1135.02(D)(2). <br />2. A variance for a fence with chains between posts; code does not permit this type, applicant <br />shows a fence with chains between posts; Section 1369.02.
