Mr. Aspery said the applicant is proposing to install seven 39-inch wooden posts connected by <br />two-inch black vinyl chain in the front yard on both sides of the driveway. The posts will have <br />two-inch vinyl caps for a total height of 41 inches, exceeding the maximum allowable front yard <br />fence height of 30 inches. The fence type is not permitted. <br />Ms. Eckstein said she removed 40-inch high bushes on both sides of her driveway and wanted to <br />install a nautical-themed fence. The 4x4-inch wood posts are covered in white vinyl with chains <br />between them. There will be four on one side of the driveway and three on the other side. Mr. <br />Papotto asked how high the chain would be from the ground, Ms. Eckstein said the chain would <br />be about one foot from the ground at the lowest point. Mr. Rahm confirmed with the applicant <br />that the fence is only for decorative purposes. Mr. Mackey said he has seen nautical fences on <br />other properties and believed it is similar to a landscape feature. Mr. Papotto pointed out that by <br />definition it is a fence and the chains would be about the height of a permitted fence. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following varianees for 18- <br />12511; Cindy Eckstein; 5887 Park Ridge Drive: <br />1. An 11 inch variance for fence height; code allows 30 in. maximum height in a front <br />yard, applicant shows 41 in.; Section 1135.02(D)(2). <br />2. A variance for a fence with chains between posts; code does not permit this type, <br />applicant shows a fence with chains between posts; Section 1369.02. <br />Motion passed 4-0. <br />18-12568; Timberous & Brittany 1VIilhous; 4586 Michael Avenue <br />Representatives: Timberous and Brittany Milhous <br />Proposal consists of a fence on a corner lot. Property is zoned C-One Family Residence. <br />The following variances are requested: <br />1. A 30 in. variance for a 5 ft. high fence constructed on a corner lot in the side yard; code <br />permits 30 in., applicant shows 60 in., Section 1135.02(D)(3). <br />2. A variance for a board on board fence constructed on a corner lot in the side yard; code <br />requires 50% open, applicant shows a board on board fence, Section 1135.02(D)(3). <br />Note: Fence is proposed to be setback 10 ft. from the side street right-of-way. Previous request <br />for 72 inch high, solid fence was denied at the October l, 2018 BZBA meeting. <br />Mr. Aspery said the applicant is proposing a fence in the side yard of their home on the corner of <br />Michael Avenue and Elm Road with frontage along Michael Avenue. Code states that a fence <br />that is at least 50% open and does not exceed 30 inches in height may be constructed on a corner <br />lot in the side and rear yards at the street line. The applicant shows a solid fence 60 inches in <br />height set back 10 feet from their side street right-of-way, therefore requiring the variances as <br />written. The applicant's fence would be allowed at the requested 10 foot setback but for the <br />height and opacity variances currently requested. Noting this specific setback would be <br />acceptable to include in a motion for approval. <br />Mr. Milhous toolc the board's concerns into account after the last meeting and decreased the <br />fence height by one foot and opened the fence up. He would like to install a fence to keep their <br />dogs and children safe. Mr. Papotto asked what the shadowbox fence is, Mr. Milhous explained <br />that the boards would alternate on both sides of the board connecting the fence posts. Mr. Raig
