18-11474; Claudia Ratica; 24928 Chase Drive <br />Representatives: Claudia Ratica, owner <br />Proposal consists of a detached deck. Property is zoned C-One Family Residence. <br />The following variance is requested: <br />1. A 5 ft. vaxiance for setback of a freestanding accessory structure; code requires 5 ft., applicant <br />shows 0 ft., Section 1135.02(C)(5). <br />Mr. Aspery said the applicant is proposing to maintain their 8 foot by 20 foot floating deck along <br />the western property line in the rear yard that was previously installed. Code requires that any <br />accessory structure be set back no less than five feet from any side or rear lot line, thereby <br />requiring a variance of five feet. A building permit is not required for the project. Ms. Ratica was <br />unaware that a variance would be required when she had a contractor install the deck. A picnic <br />table was previously in the same spot and she believed the deck added value to her property. Paul <br />Miller, the owner of 24952 Chase Drive who resides at 26864 Driscoll Lane, stated that while <br />doing work on his rental property, he did not see a picnic table in the area along his property line. <br />He was concerned about noise when the applicant has guests over. He believed the property <br />value decreased when the deck was built and that the deck could have been installed somewhere <br />else. Ms. Ratica stated her other neighbor loves the deck and believed air conditioning units are <br />louder than the people talking on her property. Mr. Papotto compared the project to having patio <br />furniture in the backyard and did not see much difference between them. Mr. Raig stated that the <br />deck is not very high and does not have a railing so it is not very noticeable. He added that there <br />are other ways to deal with the noise issue. <br />Mr. Allain moved, seconded by Mr. Papotto, to approve the following variance for 18- <br />11474; Claudia Ratica; 24928 Chase Drive: <br />1. A 5 ft. variance for setback of a freestanding accessory structure; code requires 5 ft., <br />applicant shows 0 ft., Section 1135.02(C)(5). <br />Motion passed 4-0. <br />18-11487; Sabrina Zart; 28165 Gardenia Drive <br />Representatives: Sabrina Zart, owner <br />Proposal consists of new shed and fence. Property is zoned A-One Family Residence. <br />The following variances are requested: <br />1. A 1 ft. variance for side and rear setback of the shed; code requires 5 ft., applicant shows 4 ft.; <br />Section 1135.02(C)(5). <br />2. A variance for an accessory structure located in an easement and drainage swale; code does <br />not allow accessory structures in recorded easements or in a manner than hinders the free flow <br />of storm water, applicant shows an accessory structure in a storm sewer easement and <br />drainage swale; Section 1135.02(C)(6). <br />3. A variance for a fence that is not identified as a permitted fence type; Section 1369.02. <br />4. A variance for a fence that has exposed posts on both sides; Section 1369.04(c). <br />Mr. Aspery said the applicant is proposing to install a new 8 foot by 10 foot shed in the southeast <br />corner of the property and a new wood and metal fence along the southern property line. The <br />shed encroaches on the required foot property line setback by one foot and is proposed in a <br />recorded swale and storm sewer easement over an existing inlet and 15-inch storm sewer. Ms.
