Mr. Aspery <br />explained how complaints can be handled with the city. <br />Mr. Papotto aslced where the 24-hour access would be, Mr. Gamitov stated that it will be at the <br />main entrance. Mr. Allain believed the use would be similar to a laundromat which is an <br />approved use in the B-1 Local Business district. Mr. Rahm believed the neighbors' concerns <br />were valid and should be addressed, but did not see the use variance having a negative impact on <br />the neighbors that does not already exist. Mr. Raig believed the business going in would be <br />quieter for the residents than other potential businesses, Mr. Papotto agreed. Mr. Papotto pointed <br />out that the owners have made improvements to the property but there are still ways to improve. <br />Mr. Allain suggested restricting the square footage to 5,000, similar to other uses in the chapter. <br />Mr. Allain moved, seconded by Mr. Papotto, to approve a use variance for a health and <br />fitness club in the B-1 Local Business District for 18-10730; Onyx Fitness; 24101 Lorain <br />Road, conditioned upon it not exceeding 5,000 square feet, motion passed 4-0. <br />18-10731; Ace Hardwareq 23200 Lorain Road <br />Representatives: Becky Foster, 3355 Oak Hill Road, Wooster, OH; Corey Butrem, 6712 Parma <br />Parkway Boulevard, Parma Heights, OH; Bryan Martin, 620 Mayberry Road, Lorain, OH <br />Proposal consists of accessory outdoor display and storage in the B-1 Local Business District. <br />The proposed accessory use is not a permitted use in B-1 per Section 1139.03. An accessory use <br />variance is requested. <br />Mr. Aspery said the applicant is seeking to maintain a U-Haul vehicle rental dealership in the <br />parking lot directly east of the existing Ace Hardware store at 23200 Lorain Road. The proposed <br />use is not a permitted use in Section 1139.03. U-Haul trucks are currently being stored on the <br />easternmost portion of the parking lot with clear view of the trucks from Lorain Road. Section <br />1139.01 of the zoning code states that the B-1 district is intended as "a location for convenience <br />goods and services for residents of nearby neighborhoods," and that "allowed uses should be low <br />intensity in nature, appropriate in scale and aesthetically compatible with the abutting residential <br />character." Equipment rental with accessory outdoor storage was previously prohibited in the <br />General Retail Business District when this use was established in 2016 under the old zoning <br />code. No mention was made of outdoor storage as part of the Ace Hardware approved minor <br />change application approved March 8, 2016. Under the current code, equipment rental with <br />accessory outdoor storage is a prohibited use in B-1 Local Business and B-4 Mixed Use Business <br />districts and a conditional use in the B-2 Office/Service and B-3 General Business districts. <br />Ms. Foster reviewed the letter that was submitted. She stated that it was U-Haul's responsibility <br />to secure all approvals with the city prior to entering an agreement with Ace Hardware for this <br />location and they were told they had all approvals. She believed that without the U-Haul <br />dealership, a hardship would be created for the store. When the plants have foliage, the trucks are <br />barely visible from Lorain Road. They are trying to work with the landlord to install a ground <br />sign for the plaza. Mr. Butrem, a U-Haul employee, stated that the trucks are constantly moving <br />and are not "stored" on the property. He believed that the trucks add to the property revenues and <br />economy in the area. Mr. Martin, a U-Haul employee, pointed out that having a U-Haul location
