Mr. Papotto moved, seconded by Mr. Allain, to approve the following variances for 18- <br />10974; Mukhammad Kamalov; 27478 Cottonwood Trail: <br />1. A 10 sq. ft. variance for size of an accessory structure; code permits 150 sq. ft., <br />applicant shows 160 sq. ft., Section 1135.02(c). <br />2. A 4 in. variance for height of an accessory structure; code permits 12 ft., applicant <br />shows 12 ft. 4 in., Section 1135.02(c). <br />Motion passed 3-0. <br />18-10979; Thomas Szaller; 25306 Fawn Drive <br />Representatives: Thomas & Peggy Szaller, owners <br />Proposal consists of a special permit to add a three-season room in the rear yard onto an existing <br />non-conforming building. The existing rear yard setback is 40 feet. Property is zoned C-One <br />Family Residence. <br />The following variance is requested: <br />1. A 19 ft. 10 in. variance for rear yard setback for the three season room; code requires 50 ft., <br />application shows 30 ft. 2 in., Section 1135.06(d). <br />Mr. Aspery said the applicant is requesting a variance of 19 feet 10 inches to allow for the <br />addition of a one-story sunroom to the rear of their non-conforming home. The home is <br />nonconforming because its current rear yard setback is 40 feet from the rear property line, which <br />is short of the 50 foot rear yard setback required under the current code. This proposed addition <br />would reduce this already-nonconforming distance to 30 feet 2 inches. The Board must grant a <br />special permit to add on to a non-conforming building per Chapter 1165.02 of the code in <br />addition to the setback variance requested. Mr. Szaller provided pictures showing the existing <br />patio that he is requesting to enclose. Ms. Szaller stated that the addition is already done. Mr. <br />Russell stated that this addition was built without a permit and there are structural issues. Mr. <br />Gareau asked that the Board look at the request without knowing it is built already.
