three cars that would need to go in the garage and the existing garage would be used as the shed. <br />Mr. Kozminski added that the attached garage is proposed to be larger than allow for stairs to <br />lead from the garage directly into the basement. Mr. Bennett said the closest neighbor, Mr. <br />Szabo, is in favor of the request. <br />Mike Yunich, 24836 Kennedy Ridge Road, wanted to make sure that the proposed garage will <br />not be used for commercial purposes. He was concerned that the garage location would be <br />changed and the garage doors would face his property. <br />Mr. Papotto said the attached garage is 126 square feet larger than what is allowed. He added <br />that an accessory structure would be allowed on the property and it could be 350 square feet so <br />the variance requested would only be an additiona180 square feet, therefor he did not oppose the <br />request. Mr. Mackey stated that there are other properties in the area that have large accessory <br />buildings and he has no objections to the existing garage remaining, especially since it is further <br />back from the road. Mr. Rahm agreed and added that it would be a shame to remove the existing <br />garage that is in decent shape. Mr. Allain pointed out that the Board would not be ruling on the <br />placement of the garage doors. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance for 18- <br />10992; Daniel & Elizabeth Kozminski; 24857 Kennedy Ridge Road: <br />1. A 556 sq. ft. variance for total garage floor area; code permits 750 sq. ft., applicant <br />shows 1,306 sq. ft., Section 1135.02(B)(1)(a). <br />Motion passed 4-0. <br />18-11043; Nedal Hasan; 26470 Waterburv Circle <br />Representatives: Nedal Hasan, owner <br />Proposal consists of a patio enclosure in the rear yard. Property is zoned A-One Family <br />Residence. <br />The following variance is requested: <br />l. An 8 sq. ft. variance for rear yard setback; code requires 50 ft., applicant shows 42 ft., <br />Section 1135.06(d). <br />Mr. Aspery stated that the applicant is proposing to construct a new patio enclosure in the rear of <br />their home. The dwelling's rear yard setback ranges from 64 feet to 47 feet, but the patio <br />enclosure is shown to encroach into the required 50-foot setback by eight feet. The variance <br />request should be amended to show an eight linear feet variance, not eight square feet. Mr. Hasan <br />said that he is requesting to close in an existing deck. Mr. Papotto clarified with Mr. Russell that <br />part of the home is within the rear yard setback due to the pie-shaped lot. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the following variance as <br />amended for 18-11043; Nedal Hassan; 26470 Waterbury Circle: <br />1.
