2. A 2 ft. variance for side yard setback for a garage; code requires 5 ft., applicant shows 3
ft., Section 1135.02(B)(1)(c).
3. A 60.5 sq. ft., variance for rear yard lot coverage; code permits 578.5 sq. ft. allowable
coverage, applicant shows 639 sq. ft., Section 1135.05(B)(2). See note.
Motion passed 5-0.
18-11796; Michael Johnson; 24826 Fawn Drive
Representative: Michael Johnson, owner
Proposal consists of a parking pad. Property is zoned C-One Family Residence.
The following variance is requested:
1. A 2-1/2 ft. variance for the location of a parking pad from a property line; code requires 5 ft.,
applicant shows 2-1/2 ft., Section 1135.02(B)(3)(b).
Mr. Aspery stated that the applicant is proposing a parking pad in the side yard to the rear of the
home. Code requires parking pads to be located a minimum distance of five feet from any
property line, whereas the applicant shows the proposed pad in their side yard 2-1/2 feet off the
western property line, requiring a variance of 2-1/2 feet. Mr. Johnson would like to install the
paxking pad to be able to maneuver their cars around the home. Mr. Papotto clarified with the
applicant that the parking pad would almost be up to the existing wooden fence. Mr. Johnson
said the fence belongs to the neighbor but encroaches on his property according to the
information he was given when he bought the home. The fence will not be removed when the
parking pad is installed.
Mr. Allain moved, seconded by Mr. Papotto, to approve the following variance for 18-
11796; Michael Johnson; 24826 Fawn Drive:
1. A 2-1/2 ft. variance for the location of a parking pad from a property line; code
requires 5 ft., applicant shows 2-1/2 ft., Section 1135.02(B)(3)(b).
Motion passed 5-0.
18-11798; Tim and Rochelle 1Vlartin; 25197 Deerfield Drive
Representatives: Rochelle Martin, owner; Chris Glassburn, Ward 2 Councilman
Proposal consists of a new fence on a corner lot. Property is zoned C-One Family Residence.
The following variance is requested:
1. A 30 in. variance for the height of a fence located on a corner lot in the required setback; code
permits 30 in., applicant shows 60 in., Section 1135.02(d)(3).
Note: Applicant's request for a fence not 50% open and more than 30 inches high was denied by
the BZBA on July 2, 2018.
Mr. Aspery stated that the applicant's current variance request shows a 60 inch high, 50% open
wood picket fence three feet off the sidewalk. Code permits a fence that is at least 50% open and
does not exceed 30 inches in height to be constructed on a corner lot in the side and rear yards at
the street line of the abutting lot on the side street, hence the need for the fence height variance to
allow the fence to be constructed near the street line at the 50% openness currently shown. The
applicant was denied a variance for a 60 inch high, 0% open fence at the July 2"d meeting. Ms.
Martin said they are asking for a wood picket fence that is 50% open and would be a couple feet
from the sidewalk to keep as much of their yard fenced in as possible. Mr. Glassburn believed
