Mr. Conway indicated that the auto wash was <br />created prior to the current codes. The driveway ran along the property line which was allowed. <br />When they replaced the driveway, an ex-inspector gave the owner permission to extend the <br />driveway further back. It was not brought to his attention until an abutting neighbor filed a <br />complaint and it was found that the pavement was over the neighbor's properiy line. What was <br />there prior to the current code is not an issue and the board only needs to rule on the small section <br />which was added. He questioned if the applicant had removed the encroaching concrete. Mr. <br />Yund stated that the encroaching concrcte was in fact, cut and removed. Mr. Conway questioned <br />if the concrete was pitched in order to handle the runoff. Mr. Yund reviewed that it was not their <br />intent to go against cu.rrent zoning code or encroach onto the neighbor's property. They will <br />reStore the neighbars green space and ensured that the cement was pitched correctly. The <br />additional concrete was required due to a.n increase in business. The applicant needs the room to <br />stack the cars on the site so the cazs do not spill out onto the street. Ms. Whitback indicated that <br />the cleanliness of the site had been better. Mr. Jablaonski was concerned about the rear area <br />however, looking at the plans it would not affect him. <br />N. Sergi moved to grant Andy's Auto Wash of 28800 Lorain Road their reqnest for variance <br />(1123.12), which consists of a driveway expansion and that the following variance is <br />granted: 1).
