CITY OF NORTH OLMS1'ED <br />BOARD OF ZONING APPEALS <br />MAY 5, 2005 <br />MINUTES <br />I. ROLL CALL: <br />Chairman Maioney called the meefing to order at 7:30 p.m. <br />PRESENT: Chairman J. Maloney, Boazd Members; N. Sergi, W. Kremzar, M. Diver, and T. <br />Kelly. <br />ALSO PRESENT: Assistant Law Director B. O'Maliey and Clerk of Commissions D. Rote. <br />U. REVIEW AND CORRECTION OF MINUTES: <br />W. Kremzar moved to approve the Board of Zoning'Appeals minutes dated April 7, 2005 as <br />written. T. Kelly seconded the motion, which was unanimousiy approved. <br />Chairman Maloney reviewed that there were 8 cases requesting 17 variances and one special <br />permit on the docket. He further advised that the board members had viewed the premises <br />involved for each case. Three votes are required for approval and in addition, each case would be <br />judged on the physical situation peculiar to itself, so that in no way is a judgment rendered <br />considered to be a general policy judgment affecting properties and like situations elsewhere. <br />ffi. BUILDING DEPARTMENT REQUESTS: <br />OILD BUSINESS: <br />NEW BUSINESS: <br />1. Charles Demoov; 6531 Brighton Drive: (WRD 3) <br />Request for variance (1123.12). Proposal consists of erecting a fence. <br />Tlie following variance is requested: . <br />1. A variance for fence located 15' within side setback on a corner Iot, (code does not permit, <br />applicant shows a fence). Which is in violation of Ord. 90-125 section (135.02 (172)). <br />Mr. Demooy the owner came forwazd to be sworn in and address his request. Mr. Demoay <br />reviewed that he would like to fence in his backyazd for his handicap son. He suggested that the <br />fence would be scalloped and no lvgher than 3 foot 6 inches at the highest point. <br />N. Sergi moved to grant Charles Demooy of 6531 Brighton Drive his request for variance <br />(1123.12), which consists of erecting a fence and that the following variance is granted: l. A <br />variance for fence located 15' vuithin side setback on a corner lot, (code does not permit, <br />applicant shows a fence). Which is in violation of Ord. 90-125 section (135.02 (172)). T. KeIIy <br />seconded the motion, which was unanimously approved. Variance Granted. <br />2. Joseah & Viclde Mate; 232811VIarion Road: f WRD 21 <br />Request for variance (1123.12). Proposal consists of an addition to existing house. <br />Tbe following variances are requested: <br />• A special permit to add to a non-confortning building (1165.02). Note: The existing house <br />only has a 38-foot front setback (1135.06 (A)) and only a 15-foot side setback on a corner lot <br />(1135.06 (B)). 1. A 537 square foot variance for a residence too Parge for a lot (32% total iot), (code permits <br />1875 sq ft, applicant show 2412 sq ft), section (1135.05 (C)). <br />2. A 30 foot variance for a residence too close to rear property line, (code requires 50 ft, <br />applicant shows 20 ft), section (1135.08 (A)).
