A 30 foot variance for a dwelling too close to front property line, (code requires 50', <br />applicant shovvs 20'), section (1135.06 (A)). <br />2. A 100 square foot variance for mirrianurn required livable floor space for Residential District <br />B, (code requires 850 sq ft, applicant shows 750 sq ft), section (1135.03 (B)). <br />3. A 20 foot variance for minimum width of lot in Residential District B, (code requires 70', <br />applicant shows 50'), section (1135.04 (A)). <br />4. A 4600 square foot variance for minimum square feet of a lot in Residential District B, <br />(code requires 10850 sq ft, applicant shows 6250 sq ft), section (1135.05 (A 1)). <br />5. A 10 foot variance for minimum depth of a lot in Residential District, (code requires 135', <br />applicant shows 125'), section (1135.05 (A 3)). <br />6. A'/Z story variance for height, (code perinits 21/2 stories, applicant shows 3 stories), section <br />(1135.04 (A 1)). <br />ViThich is in violation of 90-125, Sections (1135.06 (A)), (1135.03 (B)), (1135.04 (A)), <br />(1135.05 (A 1)), (1135.05 (A 3)) and (1135.04 (A 1)). <br />Mr. Lima the owner, Mr. Suliivan, Ms. Larosa, and Mr. NTaxim abutting neighbors each came <br />forward to be sworn in and address the request. Mr. O'Malley reviewed that the lot is an <br />existing lot and ca.n not be changed and the requested use is to be developed as zoned. It <br />would be good to keep in ynind that tlie majority of homes in the neighborhood aze non- <br />conforniing and suggested the commissioners keep in mind the size and Iayout of tIie existing <br />neighborhood. Mr. Lima reviewed that he purchased the lot and home so that he could build a <br />home so lus dauglater could live an the existing hoffie. A new engineering plan was siabmitted. <br />Mr. Maloney read allowed a letter submit#ed from Ms. Kellar whicla voiced that she would like <br />the existing bushes removed as they were not pPOpegiy Ynaintained and belonged to the <br />applicant. Mr. Lima sta.ted tlnat he would be happy to remove the bushes. Mr. Rymarczyk <br />indicated that the home is considered three story if the attic is finnshed off. If the applicant <br />does not finish the attic variance #6 could be eliffiinatetl. Vaaiance #2 a 100 foot variance <br />could aLso be eliminated by addi.ng 4-foot to the back of the home. Mr. Lima iIIdicated that he <br />would not live in the home but would sale the home to family members or on the market. Mr. <br />Sullivan is concerned about the distance to his hoffie. He wotald like to see the trees stay to <br />help buffer the view and only remove trees if they are dead. Ms. La.rosa would not like to see <br />the height of the home at 3 stories. All residents voieed that they did not want a 3 story home. <br />Mr. Rymarczyk stated that the height of the home would not change if the attic was left <br />unfinished it would just not le consiclered a 3 story home any longer. The applicant would aLso <br />need to rernove tlie finished stairwell shown on the plans as well. Mrs. Sergi asked if the <br />placenaent of the home would he consistent with the other homes. Mr. Maxim voiced that he <br />was in favor of the home. The applicant has been very nice and is cleaning the existing home <br />up. 1VIr. Liffia andpcated that the home is being placed 'an the same manoa' as other hoffies in the <br />neighborhood. He agreed to add 4-feet to the back of tlae home and not fmash the attic to <br />eliminate variances #2 & #6. <br />W.
