A 10 foot variance for minimnffi depth of a lot m Residcntial I2istrict, (code reqnires <br />1351, applicant shows 125'), section (1135.05 (A 3)). <br />Which is in violation of 90-125, Sections (1135.06 (A)), (1135.04 (A)), (1135.05 (A 3)) and <br />(1135.05 (A 1)). Note: The upper floor is to be an attic only and may not be used as <br />livable area. J. Maloney seconded the motion, roll call on the moteon, J. Maloney, W. <br />Kremzar, T. Kelly, M. Diver, "yes", and N. Sergi "no". Variances Granted as amended. <br />6. Timberview Homes; 5191 Dewey Road: (WRDl) <br />Request for variance (1123.12). The proposal consists of building a new house. <br />The following variances are requested: <br />1. A 22 foot variance for a dwelling too close to front property line, (code requires 50', <br />applicant shows 28'), section (1135.06 (A)). <br />2. A 75 square foot variance for a minimum 1 St floor "livable" space in Resident District B, <br />(code requires 850 sq ft, applicant shows 775 sq ft), section (11235.03 (B)). <br />3. A 20 foot variance for minimum width of a lot in Resident District B, (code requires 70', <br />appiicant shows 50'), section (1135.05 (Al)). 4. A 4519 square foot variance for minimum square area of lot in Resident District B, (code <br />requires 10850 sq ft, applicant shows 6331 sq ft), section (1135.05 (Al)). <br />5. An 8 foot 4 inch variance for minimum depth of lot in Resident Distriet B, (code requires <br />135', applicant shows 126.6'), section (1135.05 (A3)). <br />Which is in violation of 90-125, Sections (1135.06 (A)), (11235.03 (B)), (1135.05 (A1)), and <br />(1135.05 (A3)). <br />Note: The Board of Zoning Appeals previously addressed similar variances for ttus parcel at <br />their 1/29l04 meeting. However, variances that were granted expired on 1l29/05 and the new <br />ptans submitted differ from what was approved in 2004. <br />Mr. Duailap the owner and Mr. Hebebrand a neighbor each came forward to be sworn in and <br />address the request. Mr. Dunlap reviewed that in 2004 he was granted variances but they <br />expired before work vvas started He reconfigured the home to eiiminate some of tlle variances <br />that were granted last year. The square footage of the first floor was enlarged to eliminate the <br />need for that variance. Mr. Rymarczyk indicated that variance request #2 could be eliminated <br />by adding to the rear of the home. Mr. Dunlap indicated that if he added to the reaz of the <br />home the whole house would have to be reconfigured and may add additional variances. Mrs. <br />Sergi asked if the garage alignment wouid be even with neighboxing properties. Mr. Dunlap <br />uadicated thaY the new hoffie wonld be in alignment evith the other homes in the neighborhood. <br />Mrs. Sergi voiced that the boazd is to uphold the law and if there are any variances that can be <br />eiiminated they need to be eliminated. The bualding Department advised that variance #2 <br />could be eiiminated. Mr. Hebebrand had no objections to the applicant's request. <br />T. Kelly moved to grsnt Timberview Homes of 5191 Dewey Road their reqnest for <br />variance (1123.18), which consists of bnuding a aew house and that the following <br />variances are granted: <br />1. A 22 foot variance for a dwelling too close to front property line, (code requires 50', <br />applicant shows 28'), section (1135.06 (A)). <br />2.
