seconded the motion,, roll call on the motion; T. Kelly, N. Sergi, W. Kremzar "yes" and M. <br />Diver "no". "Special Permit Granted" During roll call of the motion: Mrs. Sergi commented <br />that she was extremely concerned for the safety of the residents but there are no violations of the <br />setback requirements. Therefore, she has to assume that Suburban is going to comply with all <br />building codes, fire codes and EPA standards and as there is a lack of evidence to deny the request <br />she must vote yes. Mrs. Diver commented that the reason for her vote is due to the testimony <br />given by the witness, Mr. Gray stating that there are moderate hazards and that he maintained a <br />minimum of four times that there are minimal difficulties for -chemicals as long as they are handled <br />properly. She is concerned for the proper handling of the chemicals and due to the human element <br />of something happening and that was stressed several times she has to vote no. Mr. Kremzar <br />commented that although he is voting yes, he is concerned about fire access to the site and stated <br />moderate hazards i.e. Benzene, Acetone and Butyl Acetate axe highly flammable materials and if <br />not handled properly can be a problem. Mr. Kolick stated that his clients would work with the fire <br />department. <br />4. B.A.D. Bovs Ltd; 28597 Lorain Road: (WRD 3) <br />Request for variance (1123.12). The proposal consists of signage. <br />The following variances are requested: <br />1. A 10 inch variance for height of wall sign, (code permits 4'-0", applicant shows 4'-10"), section <br />(1163.27 (C)). <br />2. A 1.43 square foot variance for a wall sign larger than code permits, (code permits 100 sq ft, <br />applicant shows 101.43 sq ft), section (1163.27 (C)). <br />Which is in violation of 90-125, Sections (1161.12 (E)), (1161.12 (C) Table), (1163.27 (C)), <br />(1163.24 (A)) and (1163.24 (B)). Note: 1). As there was no representative present BZA tabled on <br />the request on 6/2/05. BZA granted lighting variance requests #1  on 7/7/05. <br />Mr. Ferguson with Four Points Architect came forward to be sworn in and address the request. <br />Mr. Ferguson reviewed that the current sign before the board was their standard sign for their <br />building and at the last meeting they withdrew their variance request and submitted a new sign <br />which met city codes. However, after the July Board of Zoning Appeals meeting he received a <br />phone call from Planning Director Wenger who voiced a disappointment over the sign and <br />requested they purse a variance for a new sign that would better suite the building. He then met <br />with city officials to review their options and receive guidance as to how to proceed. The sizes of <br />the letters are the same but the words were stacked in the middle of the building. Planning <br />Commission wanted the sign centered as well as city officials, therefore they are back to ask for <br />the two variances for the sign. The request is 1.5% over what code allows. - <br />N. Sergi moved to grant B.A.D. Boys Ltd of 28597 Lorain Road their request for variance <br />(1123.12) which consists of signage and that the following variances are granted: <br />1. A 10 inch variance for height of wall sign, (code permits 4'-011, applicant shows 4'-1011). <br />2. A 1.43 square foot variance for a wall sign larger than code permits, (code permits 100 sq <br />ft, applicant shows 101.43 sq ft). <br />Which is in violation of 90-125, Section (1163.27 (C)). W. Kremzar seconded the motion, <br />which was unanimously approved. "Variances Granted" <br />NEW BUSINESS: <br />5. Joe Mowchan; 5790 Park RidgeDrive: (WRD 3) <br />Request for variance (1123.12).
