construct the addition. Mr. Kolick advised that the addition would be built out of 12-inch masonry <br />and the roof would be steel. The paint booths are self contained explosion proof rooms which are <br />rated class one division one. The rooms each have a fire suppression system and all materials are <br />maintained and used in those rooms. Mr. Papotto stated that he is just as concerned for the <br />residents and his workers and assured the board that safety and health of his workers and his self is <br />a concern. Workers are not allowed in the paint booths working without the proper gear. <br />Mr. Kolick submitted a report conducted to test smells to address the residents concerns. The tests <br />were conducted. at the Dover Road, and both booths were in use. He suggested that the report <br />showed that there was no way. there could be smells. Mr. Covell advised that he has a four year <br />degree in Biology and Viral Science, a Maters Degree in Public Health and has read thousands of <br />documents such as what the applicants submitted. He was shocked that it was submitted as <br />evidence and questioned if any of the applicant's representatives understood the report. He Stated <br />that the report was very misleading as the test was a one day grab sample during one condition and <br />could not meet the requirement of a true geometric mead tests and the report should be thrown out. <br />The report itself states that due to the fact it was a one day test the report is not an accurate <br />indicator as to what is taking place at the facility. Mr. Kolick stated that under city code 1123.01 <br />there are specific conditions that must be found to deny a permit. Consolidating the two locations <br />into one will help the public peace and welfare. It will relieve existing traffic problems, by <br />consolidating operations. The neighborhood is already fully developed and the existing use of the <br />building is not adversely affecting the neighborhood. 99.5% of the air born particulates are <br />removed from the booths. Consolidating the sites will help traffic not harm or increase traffic. It <br />complies with all requirements of the building, zoning and safety codes of the city. Mrs. Sergi <br />questioned how old the existing painting booths were. Mr. Ritchie indicated that the first booth <br />was installed in 1991 and the second booth was installed in 2001. He reviewed that in his more <br />than 40 years of service with the company there had only been 3 fires. There have never been any <br />complaints pertaining to odors at the existing site. The life expectancy of the paint booths are 20 <br />years if they are properly maintained and Mr. Papotto maintains his units very well. EPA permits <br />must be acquired to install, and operate the booths and the times and chemicals are listed out on all <br />of the permits. <br />Mrs. Meredith advised that she received a letter from the Planning Director stating the applicant <br />had to return to the Planning Commission due to improper notification to abutting neighbors. Mr. <br />Kolick indicated that Planning Commission granted the use permit at the June 14, 2005 Planning <br />Commission meeting. Mr. O'Malley advised that both the applicant and the resident were correct. <br />Mrs. Meredith stated that on behalf of the residents of the homeowners association they are asking <br />that the permit to add to a non-conforming building be denied under zoning code section 1123.11. <br />She suggested that Mr. Papotto himself stated that he had to remind his painters to wear the proper <br />safety gear even after 20 years. The existing problems of noise, odors and trash accumulation in <br />the area now and permitting the addition will push the problems 35 feet closer then what they are <br />now. <br />Mr. Kremzar questioned how the safety forces would access the site if an accident accrued. Mr. <br />Orr suggested that the plan was before Planning Commission who addressed that issue. There is <br />access along the west side of the building to the back end of the building. Mr. Kremzar questioned <br />if the fence would be extended from the property line to the end of the addition as it currently is <br />now. Mr. Orr suggested the fence would be placed in compliance to what ever the safety forces <br />require. <br />W.
