1. A 1000 square foot variance for an accessory storage building larger than code permits, (code <br />permits 200 sq ft, applicant shows, 1200 sq ft), section (1135.02 (D1)). <br />2. A 5 foot variance for height of accessory struciure, (code permits 12 ft, applicant shows 17 ft), <br />section (1135.02 (D3)). <br />VVhich is in violation of Ord. 90-125 sections; (1135.02 (D1)) and (1135.02 (D3)). <br />1Vdr. Scrivens the Owner and.Mr. Nlorad a neighbox each came forward to be swom in and address <br />the request. Mr. Scrivens indicated that he is a member of the archery club and he would like to <br />place his boat in the shed and the shed that is there now is sinking and there is no room for his <br />tools. The shed would be rernoved and he would like to have a work shop. The downspouts that <br />are required to be placed on the shed would be tied into a drain in the ya.rd. Nir. Marad indicated <br />that he has made a lot of changes to the home. 1VIr. Rymarczyk indicated that the size is quite large <br />and the height is larger than what code allows. Mr. Scrivens indicated that a 10 foot opening <br />requires a 2 foot clearance for the door and trusses. 1VIrs. Sergi indicated that the property is quite <br />large and there are trees that would hide the shed. She asked if the use of the shed would be used <br />for any type of business. Mr. Scrivens sta.ted that he would not be using the shed for a business. <br />Mr. Rymarczyk asked if there would be any vehicles parked in the shed. Mr. Scrivens indicated <br />that at some time in the future he may place a driveway. <br />N. Sergi movecl to grant Rick Scrivens of 5560 Colvambia Road lnis request for variance <br />(1123.12), which consists of a new storage building and that the following variances are <br />granted: <br />1. W. <br />Kremzar seconded the motion, roll call on the motion; J. Maloney, T. Kelly, N. Seagi "yes" <br />and M. Davet°, W. Kremzar "no" Variances Granted. W. Kremzar and M. Diver felt the size <br />of the building was excessive. J. Maloney felt that due to the size of the yard the size of the <br />building was acceptable. <br />6. John 1VIcClachertv; 29600 Stewart Drive: (WRD 3) <br />Request for variance (1123.12). The proposal consists of a new fence. <br />The following variances are requested: <br />1. A 20 foot variance for a 6 foot fence located in side yard setback on a corner lot, (code does <br />not allow, applicant shows a fence). <br />2. A variance for a fence in required side yard setback less than 50% open, (code requires 50% <br />open, applicant shows solid). <br />3. A 42 inch variance for a fence higher than 30 inches in required side yard on a corner lot, (code <br />pertnits 30", applicant shows 72"). <br />Which is in violation of Ord. 90-125 section (1135.02 (F1)). <br />Mr. McClacherty the owner came forward to be swoxn in and address the request. Mr. <br />McClacherty indicated that at 8:00 pm the amount of traffic increases and headlights from the cars <br />shine into their windows so they would like to have a shadowbox type fence to block or decrease <br />the lights. Mr. Rymarczyk indicated that a shadow box fence is not 50% open. _ W. McClacherty <br />indicated that if the fence was placed to code it would be plaeed half way in his backyard. The <br />split rail fence that is there would be left from the house to the front yard. He would place the <br />fence far enough (2-feet) from the sidewalk to run the lawnmower along the fence.
